Title:IZZIVI UVELJAVLJANJA PRAVIC IZ NEREGISTRIRANE ZNAMKE - PROBLEMI OBSTOJEČE UREDITVE IN MOŽNE REŠITVE

Abstract:Poleg registrirane znamke je v nacionalnih sistemih pravnega varstva znamk pod določenimi pogoji zagotovljeno tudi varstvo neregistrirane znamke in drugih znakov, s katerimi se posluje v gospodarskem prometu. Na tem področju harmonizacija na ravni EU zaenkrat še ni predvidena, zato se ureditev področja neregistriranih znakov od države do države razlikuje. Magistrska naloga obravnava problematiko obstoječe pravne ureditve pravnega varstva neregistriranih znakov v Sloveniji. Skozi proučevanje veljavnih določb predpisov, ki se nanašajo na varstvo neregistriranih znakov in obstoječe slovenske in nemške sodne prakse ter sodne prakse sodišč EU, magistrska naloga opredeljuje možnosti uveljavljanja pravic iz neregistriranih znamk in drugih prejšnjih pravic oziroma znakov, ki so v uporabi v gospodarskem prometu v Sloveniji ter primerljivo v Nemčiji in na ravni EU. Posebna obravnava je namenjena nedvomno znani neregistrirani znamki iz 6. bis Pariške konvencije, ki je poleg varstva na podlagi določb predpisov o varstvu pred nelojalno konkurenco, praktično edina oblika varstva neregistrirane znamke v Sloveniji. Glede na to, da je prag za doseg varstva v primeru nedvomno znane znamke precej visok, magistrska naloga opredeljuje možnosti za izboljšanje pravnega varstva v smislu vključitve posebnih določb, ki se nanašajo na varstvo neregistrirane znamke, ki je v uporabi na območju Slovenije, vendar ne dosega praga potrebnega za to, da se obravnava kot nedvomno znana znamka. Takšna ureditev bi bila primerljiva ureditvi varstva neregistrirane znamke v Nemčiji.

Title:Enforcement of Unregistered Marks – Problems of the current protection and possible solutions
Abstract:The national trade mark systems of the European Union (EU) Member States offer protection to both registered and non-registered trade marks. However, while the law in relation to registered marks has been `harmonised´ throughout the EU, the national laws concerning the protection of non-registered trade marks and other commercial signs used in the course of trade vary greatly across the EU. This thesis undertakes a comparative analysis of the EU national laws protecting non-registered trade marks and other commercial signs used in the course of trade, and highlights the need for improvements in the law by reference to the specific case of Slovenia. It examines the law and current practice in Slovenia by comparison and contrast with the approach taken in Germany and the European Union Intellectual Property Office. In Slovenia, the concept of an unregistered well-known mark, which derives from Article 6.bis of the Paris Convention is, along with the unfair competition provisions, the exception to the rule that exclusive rights over a trade mark are obtained through registration. As the necessary threshold for the mark to be considered as a well-known mark is normally very high, the thesis addresses the possibility of introducing a concept of an unregistered mark which is merely used in the course of trade but are not considered to be well-known in Slovenia. Such protection has long been afforded to the unregistered signs used in the course of trade in Germany, for example.
