Title:VPLIV NORMANSKE INVAZIJE NA ANGLOSAŠKI PRAVNI SISTEM

Abstract:Zgodovina anglosaške Anglije je zgodovina neprestanih bojev za oblast, nestabilnih družbenih razmer in invazij. V tako heterogeni družbi, razdrobljeni na več majhnih državic, od katerih je v različnih obdobjih ena ali druga prevzela primat, se nikoli ni izoblikovala močna centralna oblast z enotnimi pravili in pravnimi normami. Kljub temu se je izoblikoval pravni sistem pravil, ki je temeljil na običajnem pravu, le-ta pa je imel veliko skupnih prvin, ki so izvirale iz germanske tradicije. To tradicijo je občasno prekinilo obdobje vpadov skandinavskih osvajalcev, ki so si z mirovnimi sporazumi zagotovili obširna območja, kjer so veljali njihovi običaji in zakoni, dokončno pa invazija pod vodstvom Viljema Osvajalca. Angleška centralno urejena fevdalna država ima svoje korenine v normanski invaziji, ki je spremenila anglosaško klansko ureditev in jo nadomestila z osebnim vazalstvom vezanim neposredno na vladarja. Viljem je s preprostimi, a strogimi zakoni enotno uredil kazenskopravno ureditev. S tem je ustvaril temelje močni centralizirani državi pod vodstvom vrhovnega poglavarja z enotno ureditvijo na njenem celotnem ozemlju. Normani kljub prevzemu oblasti niso popolnoma spremenili pravnega sistema, ampak so ga le nadgradili tako, da jim je bilo olajšano vladanje nad novimi podaniki. Vpeljali so nekatere prvine kontinentalnega fevdalnega prava in v pravni red vpeljali nekatere inovativne rešitve, ki so bile unikatne v tedanji Evropi. V tem času se začne oblikovati common law sistem kot prizadevanje, da se pravo enotno uredi na celotnem območju, ki je pod kontrolo Normanov.

Title:THE INFLUENCE OF NORMAN INVASION ON THE ANGLO-SAXON LEGAL SYSTEM
Abstract:The history of Anglo-Saxon England is one of constant fighting for rule, of unstable social circumstances and invasions. In such a heterogeneous society, fractured in many small states, each taking primacy from time to time, a strong central authority with uniformed rules and standards never formed. Yet, a legal system was broadly used, based on customary law with strong elements of Germanic tradition. This tradition was periodicly interrupted by Scandinavian conquerors, which ensured with peace treaties wast areas under their laws and finally with the invasion under the leadership of William the Conqueror. The centralistic feudal English state has its origins in the Norman invasion, which changed the Anglo-Saxon clannish order and replaced it with personal vasselage bound directly to the ruler. William regulated the criminal law system with simple, but strict rules and so laid the foundation for a strong centalistic state under a supreme commander. Despite the Norman seizure of power, the legal system was not utterly changed, but merely upgraded to ensure easier rule over their new subjects. They introduced some elements of the continental feudal law and some innovative solutions to the law system, which were unique in Europe at that time. In that time, the common law system starts forming as a aspiration to uniform the law system in the area of Norman control.
