Title:Davčnopravni vidik odprave neenakosti obravnave lastniškega kapitala pri financiranju poslovanja gospodarskih družb

Abstract:Davčna zakonodaja na področju obdavčevanja dohodkov pravnih oseb v večini držav članic EMU dovoljuje, da se strošek obresti iz dolžniškega financiranja, skladno z omejitvami, ki so prisotne na nacionalni ravni, obravnava kot davčno priznan odhodek in kot tak znižuje davčno osnovo gospodarskih družb. To postavlja gospodarske družbe, ki so sposobne financirati poslovanje z lastnimi viri, v neenakopraven položaj, saj davčna zakonodaja stroška financiranja z lastnimi viri ne upošteva kot davčno priznanega odhodka. Taka naklonjenost davčne zakonodaje dolžniškemu financiranju spodbuja uporabo dolžniškega financiranja, kar dolgoročno negativno vpliva na finančno trdnost gospodarskih družb. Zadnja globalna gospodarska kriza je pokazala, kako lahko visoka zadolženost škodi ne le gospodarskim družbam, temveč tudi državam, ki so z dodatnim zadolževanjem poskušale preprečiti poglobitev gospodarske krize in so s tem breme prenesle nase, kar je za nekatere članice EMU pomenilo skorajšnjo nezmožnost poravnavanja lastnega dolga. Zato je toliko bolj pomembno, da se davčno zakonodajo na področju obdavčevanja dohodkov pravnih oseb spremeni na način, da se v čim večji meri izenači davčna obravnava lastniškega in dolžniškega načina financiranja gospodarskih družb. Pričujoča magistrska naloga analizira, na kakšen način se lahko doseže odpravo neenakosti obravnave lastniškega kapitala pri financiranju poslovanja gospodarskih družb. Nadalje primerja metode, s katerimi se lahko odpravi neenakost obravnave lastniškega kapitala in kakšen pristop so posamezne države, članice Evropske unije, pri tem izbrale. Izpostavljeni sta predvsem Belgija in Italija, ki sta na tem področju v zadnjih desetih letih storili največ, in sicer z vpeljavo odbitka za lastniško financiranje (ACE). Pričujoče delo prouči možnosti za odpravo obravnave neenakosti lastniškega kapitala v Sloveniji po vzoru Belgije in Italije in možne učinke, ki bi jih ta metoda imela na gospodarske družbe v Sloveniji.

Title:Fiscal and legal aspects of eliminating the inequality in the treatment of equity capital used to finance the business operation of companies
Abstract:Subject to the restrictions present on national level, corporate tax legislation in most EMU Member States allows the interest expense from debt financing to be regarded as a tax deduction thus reducing the tax base of companies. This puts companies that are able to finance their business operation with their own resources in an unequal position because the tax legislation does not consider own-resource financing expenses as a tax deduction. Such favoured treatment of debt financing by the tax legislation promotes the use of debt financing, which has a long-term negative impact on the financial strength of companies. The last global economic crisis has shown how high indebtedness harms not only companies but also countries, which tried to prevent the deepening of the economic crisis with additional debt thus transferring the burden on themselves. As a result, some EMU Member States almost failed to settle their debt. This is why it is all the more important to amend corporate tax legislation in a way that equalizes as much as possible the tax treatment of equity financing and debt financing of companies. The present master’s thesis analyses how we can achieve the elimination of inequality in the treatment of equity capital used to finance the business operation of companies. Moreover, it compares the methods that can be used to eliminate the inequality in the treatment of equity capital and the approach chosen by individual European Union Member States. The paper singles out especially Belgium and Italy which have made the greatest progress in this area in recent years, namely by introducing the Allowance for Corporate Equity (ACE). The thesis also examines the possibilities of eliminating the inequality in the treatment of equity capital in Slovenia modelled on Belgium and Italy, and the possible effects this method would have on the companies in Slovenia.
