Title:Pravica do izobraževanja študentov invalidov

Abstract:Živimo v globalni dobi, kjer tehnologija hitro napreduje. To vpliva na dejstvo, da vedno več študentov invalidov, tudi tistih z najtežjimi oblikami invalidnosti, želi študirati in se vpisuje na študij. Znanje je vrednota in ključ do samostojnosti, razgledanosti, občutka lastne vrednosti in samozavesti. S pridobljeno izobrazbo se študentje opolnomočijo za polno, neodvisno življenje, v kolikor lahko znanje manifestirajo in plemenitijo v vsakdanjem življenju z zaposlitvijo. Tako se razvijejo v samostojne, močne osebnosti, sposobne reševanja problemov. Na področju visokošolskega izobraževanja so stvari sistemsko in zakonsko še skopo urejene. V zadnjih letih so vse tri javne univerze, Univerza v Mariboru, Univerza v Ljubljani in Univerza na Primorskem, sprejele pravilnike, s katerimi urejajo pridobitev statusa študenta invalida, pravice in obveznosti študentov invalidov ter prilagoditve izvajanja študijskega procesa ter izpitov. Kljub temu, še vedno ostaja veliko praktičnih problemov in odprtih vprašanj, ki jih je potrebno zakonodajno urediti in nato zagotoviti njihovo dosledno implementacijo na zakonski in podzakonski ravni. Še vedno ni zagotovljenih ustreznih finančnih sredstev, ki bi študentom invalidom omogočala polnopraven študij. Le-ti to najbolj občutijo pri financiranju tehnične opreme, pripomočkov in posebnih prilagoditev, ki jih potrebujejo za uspešen in učinkovit študij. Prav tako je ključnega pomena dostopnost, fizična in ostala pomoč, da lahko sledijo študijskemu procesu in aktivnostim. Vse to bi moralo biti sistemsko urejeno, da bi omogočilo enakovreden, neodvisen študij. Sem spadajo predvsem fizična dostopnost, mobilnost, pomoč pri vsakodnevnem funkcioniranju in zagotavljanju pogojev za sodelovanje študentov invalidov. Ni enotne definicije študenta invalida. Kljub razvoju inkluzivnega šolstva in napredku na tem področju, še vedno naletimo na diskriminacijo študentov invalidov, včasih zaradi neustrezne implementacije pravilnikov, predolgega odločanja, predvsem pa zaradi pomanjkanja finančnih sredstev in zaradi tega, ker pravice študentov invalidov še vedno niso sistemsko urejene. Z intervjuji smo povprašali študente invalide, kakšen je njihov pogled na študij, kako izvajajo svoje pravice in obveznosti, ter kaj bi potrebovali za izboljšanje svojega položaja ter uspešen zaključek študija.

Title:Right to education for students with disabilities
Abstract:We live in a global age with great technological advancements. Thanks to these advancements, more and more disabled people, even those with the most severe disabilities, enter further or higher education. Knowledge is highly valued and is a key to independence, self-confidence and self-worth. Education empowers disabled people to live a full and independent life, especially when they can manifest and further develop their competences in employment. They become problem solvers, strong and independent. The field of higher education and inclusion of disabled people on systemic and legislative level as well as in practice is still poorly developed. All three public universities, the University of Ljubljana, the University of Maribor and the University of Primorska have in recent years adopted internal regulations which regulate disclosure procedures, the rights and responsibilities of disabled students and provisions of reasonable adjustments in learning and assessment. Despite this, many practical issues and dilemmas still exist, which would need to be addressed and regulated by legislation followed by consistent implementation. There is still no systematic financing to make higher education truly inclusive. Disabled students are most affected with regard to access to technical and assistive aids as well as provision of reasonable adjustments. Physical access, personal assistance and study support which are also key, remain without proper funding. All these areas should be systematically regulated to enable disabled students to have equal educational opportunities. This includes physical access, mobility, help in daily living functioning and ensuring participation of disabled students. There is no common definition of a disabled student. Despite developments and advancements in inclusive education, discrimination on the grounds of disability still occurs, sometimes due to inappropriate implementation of the regulations, decisions taking too long and foremost due to the lack of financial resources and gaps in legislation. Interviews with students provided information on their experience of higher education, how they exercise their rights and responsibilities and what they would need for a better experience of studying and for obtaining a degree.
