Abstract:Diplomsko delo predstavlja analizo sodnih odločitev slovenskih sodišč na temo bianko menice, ki predstavlja pomemben institut zavarovanja bodočih terjatev, pri katerih v trenutku izdaje bianko menice vsebina in obseg še nista znana. Sam pojem bianko menice ni urejen v Zakonu o menici, vsaj neposredno ne, zato so za njegovo spoznavanje, razlago in razumevanje toliko bolj pomembne odločitve sodišč, ki sicer niso formalni pravni vir, saj se je institut bianko menice večinoma razvil prav iz prakse in danes celo prevladuje nad uporabo popolne menice, ki jo ureja Zakon o menici. Bianko menica za razliko od popolne menice ob izdaji ne vsebuje vseh sestavin, saj se te vpišejo kasneje, zato sta v povezavi s tem zelo pomembna poštenost in zaupanje, ki sta dostikrat kršena, hote ali nehote. Prav zaradi nepopolnosti bianko menice se pri njeni kasnejši izpolnitvi pojavlja ogromno sporov, ki so dostikrat posledica nepoznavanja oziroma napačnega poznavanja pravil o menici. Prvi obravnavan problem se nanaša na veljavnost menice v primeru, ko ta ne vsebuje vseh bistvenih sestavin v trenutku, ko je dana v promet. Kot najpogostejši se pojavljajo problemi, ki se nanašajo na samo izpolnitev meničnega blanketa. V teh primerih prihaja do nepravilne izpolnitve manjkajočih sestavin, kar pa pomeni prekoračitev meničnega pooblastila. Zadnji sklop problemov pa se nanaša na aval. V tem delu sta obravnavani vprašanji, kdaj je aval sploh dan in pa vprašanje avalistovih ugovorov, natančneje, katere ugovore lahko uveljavlja.

Title:BIANCO BILL OF CHANGE - ANALYSIS OF COURT DECISIONS
Abstract:The following diploma thesis represents the analysis of the judicial decisions of the Slovenian courts on the subject of blank bills of exchange, which are considered an important instrument for insurance of future receivables, whose subject and amount are not yet known at the time of issuing such blank bill. The concept of a blank bill of exchange itself is not regulated by the Bill of Exchange Act, at least not directly, therefore the court decisions are so much more important when it comes to getting familiar with, explaining and understanding of this concept, even though they are not considered a formal source. The institution of the blank bill of exchange was namely mainly developed from practice and as such nowadays even prevails over the use of the complete bill of exchange, regulated by the Bill of Exchange Act. Unlike the complete bill of exchange, the blank bill of exchange at the time of issue does not contain all of the constituents, as these may be entered at a later time, therefore fairness and trust are very important in this context, as they are often violated, willingly or unwillingly. It is because of the imperfections of the blank bill of exchange that at its subsequent fulfilment numerous conflicts emerge, which are often a result of ignorance or erroneous understanding of the rules of the bill of exchange. The first problem addressed relates to the validity of the bill of exchange in the case where it does not include all the key constituents at the moment when it is placed on the market. As the most common problems arise those relating to the fulfilment of bill of exchange form. In these cases incorrect completion of the missing constituents occur, which means exceeding the bill of exchange authority. In this section two issues are discussed, namely when surety of a bill of exchange (aval) is given at all and the question of the avalist’s objections, and more precisely, which objections may be exercised.
