Title:Sistematičnost kot imanentna lastnost modernega prava

Abstract:Avtor obravnava sistematičnost kot imanentno lastnost modernega prava. Ugotavlja, da ta ni bila prisotna pri vseh zgodovinskih pojavnih oblikah prava, ampak se je oblikovala šele na prehodu iz 18. v 19. stoletje. Razumevanje prava kot sistema zahteva jasno opredelitev koncepta sistemske ustrojenosti. Pri tem opaža, da se lahko splošni nauki o sistemih aplicirajo tudi na področje prava. Toda pravni sistem se od ostalih (ne)družbenih sistemov bistveno razlikuje, saj so njegovi elementi normativne kvalitete. Zaradi tega se morajo meje med pravnim sistemom in njegovim okoljem jasno določiti, saj lahko pravne posledice pripisujejo le pravni elementi. Obravnavanje prava kot sistema omogoča, da razvijemo številne koncepte pravnega sistema. Ni namreč vseeno, če pravo obravnavamo kot sistem hierarhično ali znanstveno razvrščenih pravnih pravil, ga razumemo kot zaprto ali odprto strukturo, opazujemo njegovo notranjo ali zunanjo ustrojenost, ali ga obravnavamo v njegovi idealni obliki ali kot približek temu idealu. Pravni sistem ima štiri poglavitne lastnosti, ki zagotavljajo njegovo sistematičnost. Enotnost izhaja iz t.i. temeljnega pravila, katerega poglavitna naloga je vnašanje enotnosti v pravno materijo. Koherentnost, popolnost in določnost pravnega sistema se medtem nanašajo na zahtevo, da v pravu ni pretiranih pravnih praznin, protislovij in nedoločnosti. Ker se tem pomanjkljivostim ni možno izogniti v celoti, je potrebno poiskati načine njihovega odpravljanja. Zadnje poglavje se nanaša na ugotovitev, da je koncept pravnega sistema tesno povezan s pravno razlago. Poglavitna pri tem je razlaga s pomočjo sistema, ki zajema sistematično in sistemskoskladno razlago. Avtor odgovarja tudi na številna druga vprašanja, katerih poznavanje je nujno za razumevanje glavnih tem magistrskega dela. Podrobneje prikaže razlikovanje med pravnimi pravili in pravnimi določili, normativnimi konflikti in konkurenco pravnih pravil, razveljavitvijo in neuporabo protislovnih pravnih pravil ter pravnim sistemom in pravnim redom. Zato lahko delo razumemo kot zaokrožen prikaz sistematičnosti kot imanentne lastnosti modernega prava.

Title:Systematics as an immanent characteristic of modern law
Abstract:The author considers systematics as an immanent characteristic of modern law. He is noting, that the systemic nature was not a characteristic of all historical forms of law, but only appeared at the turn of the 18th to the 19th century. Understanding law as a system requires a clear definition of systemic structures. In this regard, the general systemic theories can be applied in the field of law. However, the legal system is different from other (non) social systems, because its elements have a normative quality. Consequently, the boundaries between the legal system and its environment have to be clearly specified, because only legal elements can cause legal consequences. Understanding law as a system makes it possible to develop several concepts of the legal system. We can consider law as a system of hierarchically or scientifically classified legal rules, it can be viewed as a closed or open structure, we can look at its internal and external structure and consider it in its ideal form or as an approximation to this ideal. The legal system has four main characteristics that ensure its systematic nature. Unity stems from the so-called basic rule, whose main task is to ensure unity of the legal material. Coherency, completeness and definiteness of law refer to the requirement, that the legal system can not have excessive legal gaps, contradictions and uncertainties. Due to the fact that those imperfections can not be avoided, it is necessary to create methods for their elimination. In the last chapter, the author notes that the concept of legal system is closely linked to legal interpretation. Interpretation with the help of the system includes systematic interpretation and interpretation in conformity with the system. The author additionaly addresses many other questions that are essential for understanding the main topics of the thesis. He also presents the distinction between legal rules and legal provisions, between normative conflicts and competition of rules, between invalidation and non-applicability of contradictory legal rules and between the concept of legal order and legal system. Therefore, the thesis can be understood as a comprehensive account of systematics as an immanent characteristic of modern law.
