Title:PRAVICA DRŽAVLJANOV TRETJIH DRŽAV DO PREBIVANJA V EU PO RAZVEZI

Abstract:Diplomska naloga analizira sodbo Sodišča Evropske unije (v nadaljevanju: Sodišče EU) v zadevi Singh in drugi, v kateri je Sodišče EU podalo razlago o tem, da zakonec ohrani pravico do prebivanja v primeru razveze, če je ob začetku postopka za razvezo zakonske zveze, državljan Unije v državi članici gostiteljici. Čeprav državljan tretje države izpolnjuje pogoj za ohranitev pravice do prebivanja, ker je zakonska zveza trajala več kot tri leta, od tega eno leto v državi članici gostiteljici, vseeno ne ohrani pravice do prebivanja, če je pred začetkom postopka za razvezo državljan Unije odšel iz države članice gostiteljice. To pravico izgubi že z odhodom zakonca in jo z razvezo ne pridobi nazaj. Naloga analizira tudi pojem »zadostna sredstva«, ki se zahteva kot pogoj za prebivanje državljana Unije, na ozemlju države članice gostiteljice daljšem od treh mesecev. Ti pravico pridobijo tudi, če sredstva delno temeljijo na sredstvih zakonca, ki je državljan tretje države, ta pa ima pravico opravljati delo po pravu EU z namenom, da takšna sredstva zagotovi.

Title:THE RIGHT OF THE THIRD-COUTRY NATIONALS TO LIVE IN THE EU AFTER DIVORCE
Abstract:This thesis analyzes the judgement of the Court of Justice of the EU (hereinafter CJEU) in the case of Singh and others in which the CJEU has adopted the interpretation that, in the event of divorce, the spouse retains the right of residence if they are a citizen of the Union in the host Member State during the divorce proceedings. Although the third country national meets the conditions for the retention of the right of residence, as their marriage has lasted for more than three years, with one year living in the host Member State, they do not retain the right of residence if the citizen of the Union left the host Member State before the commencement of the divorce proceedings. The right is lost with the departure of their spouse and can not be recovered after the divorce. The purpose of the thesis is also to analyze the concept of »sufficient resources«, which are required as a condition of residence of a Union citizen in the host Member State for a period exceeding three months. They acquire the right even if the funds are partly based on the assets of their spouse who is a national of a third country and has the right to perform their duties under EU law in order to ensure such funds.
