Abstract:
V tem diplomskem delu sta prikazana ponovna prisilna poravnava in stečaj nad dolžnikom Merkur ‒ trgovina in storitve, d. d. Hkrati je prikazano tudi poslovanje izčlenjenih družb Merkur trgovina, d. d. in Merkur nepremičnine, d. d. Skušali smo prikazati prednosti in slabosti ponovne prisilne poravnave z izčlenitvijo ter stečaja dolžnika oz. razliko med njima. Predstavljena sta unovčevanje premoženja stečajnega dolžnika in načrt finančnega prestrukturiranja, ki je bil podlaga za odločanje o ponovni prisilni poravnavi.

Abstract:
This thesis’ subject matter is the re-compulsory settlement procedure and bankruptcy of the debtor Merkur – trgovina in storitve, d. d. It also includes the presentation of the operations of hived-off companies Merkur trgovina, d. d. and Merkur nepremičine, d. d. We tried to present the difference or the advantages and disadvantages of the re-compulsory settlement with the hive-off and bankruptcy of the debtor, including a cost-benefit analysis of the liquidation of debtor assets and financial restructuring plan which formed the basis of the settlement
