Title:Zakonitost posegov v zasebnost z vidika Zakona o detektivski dejavnosti

Abstract:Diplomsko delo predstavlja detektivsko dejavnost v Republiki Sloveniji in obravnava meje dovoljenih posegov v zasebnost posameznika s strani detektivov. Predmet diplomske naloge je obravnavan z vidika upoštevanja ustavnosti, zakonitosti, dovoljenosti ter upravičenosti posegov v ustavno pravico do zasebnosti. Temeljna pravica posameznika je pravica do zasebnosti, v katero je dovoljen poseg na podlagi Ustave Republike Slovenije, ob upoštevanju vseh pravnih predpisov, ki urejajo to področje. Diplomsko delo obravnava tudi sodno prakso glede (ne)dovoljenih posegov v zasebnost ter prikazuje omejitve in dileme pri samem izvajanju detektivske dejavnosti. Ljudje so se odločili, da bodo odstopili del svojih pravic v zameno za večjo varnost. Kako določiti mejo, kjer ne prihaja do prekoračitve posegov s strani detektivov in se približati ustreznemu razmerju med učinkovitostjo njihovega dela in spoštovanjem človekovih pravic in temeljnih svoboščin? Posegi v zasebnost kot upravičenje detektivov na eni strani in sočasno varovanje človekovih pravic, zlasti pravica do zasebnosti, na drugi strani, predstavlja določeno dualnost. Gre za razmerje med varnostjo in svobodo oziroma ustavno pravico naročnika do pridobitve dokazov in ustavno pravico posameznika do zasebnosti. Pravica do zasebnosti se lahko konča samo takrat in tam, kjer kolidira z zakonsko izkazanim močnejšim interesom drugih. Detektivova poglavitna naloga je, da na podlagi pooblastila naročnika izvaja svoja upravičenja in svoje ugotovitve ter dokaze zgolj preda naročniku. Detektivi tako sami ne smejo presojati, kaj je pravilno in kaj ne, v zvezi z uporabo upravičenj pa jim je prepovedano vse, kar v zakonu ni izrecno dovoljeno.

Title:Legality of interference with the privacy in the terms of the Detective Activities Act
Abstract:The thesis introduces detective work in the Republic of Slovenia and discusses the limits of permitted invasion of an individual’s privacy by the detectives. The subject of thesis is discussed in terms of constitutionality, legality, permissibility as well as eligibility to invade the constitutional right to privacy. The right to privacy is the fundamental right of an individual, which can only be invaded by actions fully in compliance with the Constitution of the Republic of Slovenia and the relevant national legislation. The thesis also discusses the case law on (un)authorised invasion of privacy and presents restrictions and dilemmas of the detective work itself. People have decided to give up a part of their rights in exchange for greater security but how can we determine the limits and not invade the right of privacy too excessively and how can we get closer to the proper proportion between the efficiency of their work and full respect of human rights and fundamental freedoms? Detectives’ authorised invasion of privacy on one hand and, at the same time, the protection of human rights, especially the right to privacy, on the other hand, present a certain duality. It is a relation between security and freedom, moreover, relation between the constitutional right of a client to gather the necessary evidence and the constitutional right to privacy. The right to privacy can be invaded only then and there, when and where it collides with legally demonstrated stronger interest of others. A detectives’ main task is to execute his or her work and powers based on the authorisation given by a client, as well as to deliver records and evidence to their client. Detectives are not allowed to judge what is correct and what is not and as far as entitlement is concerned and for them every authority that is not explicitly permitted by the law is prohibited.
