Title:IZKLJUČITEV DUNAJSKE KONVENCIJE O MEDNARODNI PRODAJI BLAGA NA PODLAGI 6. ČLENA

Abstract:Dunajska konvencija je bila ustanovljena z razlogom unifikacije in harmonizacije mednarodnega prodajnega prava. Do danes jo je ratificiralo 84 držav po vsem svetu. Ena izmed njenih najpomembnejših značilnosti je njena dispozitivna narava, ki jo zagotavlja z možnostjo izključitve uporabe. Tako v celoti, kakor tudi posameznih členov. Takšna izključitev je mogoča tako eksplicitno, kakor tudi implicitno. Eksplicitna izključitev Dunajske konvencije je lahko zapisana v sami prodajni pogodbi ali pa je za njeno izključitev sklenjen poseben sporazum. Implicitna izključitev je dopustna le, da je volja izključiti Dunajsko konvencijo resnična, zavestna in soglasna s strani vseh pogodbeni strank. Vendar ima tudi izključitev Dunajske konvencije svoje izjeme. Tako so v sami konvenciji členi, ki jih ni mogoče izključiti, kot na primer 12. člen. Iz zabeležene sodne prakse je razvidno, da se Dunajska konvencija precej pogosto izključuje. Predvsem ZDA in Avstralija zaostajajo za drugimi državami. Najmanjši procent izključitve je razviden v evropskih državah, kakor tudi na Kitajskem. To nakazuje, da bi lahko Dunajska konvencija imela še večji vpliv na mednarodno prodajno pravo, če njeno izključevanje ne bi bilo tako pogosto.

Title:EXCLUSION OF THE VIENNA CONVENTION ON THE INTERNATIONAL SALE OF GOODS BASED ON ARTICLE 6
Abstract:The CISG was established with the intention to unify and harmonize international trade law. To this day it was ratified by 84 countries around the world. One of the CISGs most important featueres is it's dispositive nature, which is provided via the possibility of exclusion. It can be excluded in full or partialy. That can be achived either explicitly or impicitly. Explicit exclusion can be written into the Contract of sale or the contracting parties can enter into a new agreement. The implicit exclusion is admissible only if the will of both contracting parties is genuine, concious and unanimous. The exclusion of the CISG has its exceptions, articles that can't be excluded. One such Article is Article 12. Because of the recorded case law, we can summarize, that the exclusion of the CISG is quite frequent. Especially the USA and Australia lagg behind other countries. The CISG is least excluded in European countries and China. All written above suggests, that the CISG could have even more effect regarding internatioal trade law, if it wasn't excluded quite so often.
