Title:Uporaba dronov - med praktičnimi možnostmi in zakonskimi (ne)omejitvami : diplomsko delo univerzitetnega študija

Abstract:Možnosti uporabe dronov so številne, uporablja se jih na varnostnih kakor tudi na civilnih področjih. Na varnostnih področjih lahko z droni veliko prispevamo k učinkovitosti izvajanja vojaških in policijskih nalog. Čeprav so drone sprva uporabljali samo za vojaške naloge se njihove pozitivne lastnosti in širok spekter možnosti uporabe vedno bolj širi na civilna (komercialna področja). Tako se droni že uporabljajo kot pomoč v kmetijstvu, v filmski industriji, novinarstvu, vedno bolj razširjena pa je uporaba dronov za namene rekreacije in športa. Prehod iz vojaških na civilna področja je omogočil vedno večji trg dronov ter posledično tudi padec cen. Tako lahko že praktično vsak kupi kakovosten dron s kamero za nekaj deset evrov. Povečano število dronov na nebu kliče k zakonski ureditvi tega področja. Države članice EU morajo vsaka posebej predpisati pravila in omejitve uporabe dronov, saj na ravni EU takšne zakonodaje še ni. Pomembno je, da države sprejmejo takšno zakonodajo, ki na eni strani varuje človekove pravice na drugi strani pa dopušča razvoj tega področja. Ob pregledu zakonodaje v različnih državah (Sloveniji, Avstriji, Veliki Britaniji, Franciji in ZDA) je moč opaziti določene podobnosti (npr. omejitve višine letov, minimalna oddaljenost od ljudi in objektov itn.). Z droni, ki imajo senzorje za zajem osebnih podatkov (kamere, fotoaparti) lahko hitro posežemo v pravico do zasebnosti posameznika, zato je pomembno, da je zakonodaja napisana tako, da varuje človekove pravice. Poleg možnih posegov v zasebnost ljudi, uporaba dronov predstavlja tudi nekatere druge grožnje in tveganja. Ne moremo povsem odmisliti nevarnosti v primeru padca drona, grožnje pa predstavljajo tudi droni, ki jih uporabljajo kriminalne skupine za izvedbo kriminalnih dejavnosti, kot je na primer tihotapljenje drog s pomočjo dronov.

Title:Uporaba dronov - med praktičnimi možnostmi in zakonskimi neomejitvami
Abstract:There are numerous uses for drones, they are being used both in security and civil fields. In the field of security they can greatly contribute to the effectiveness of military and police work. Even though drones were primarily used only for military missions, their positive attributes and wide specter of use is more and more present in civil (commercial) spheres. Drones as such are now being used in farming, movie industry, journalism and ever more present is their usage for recreation and sport. The spread from military into civil spheres has caused a large market and a subsequent drop of drone prices. This way almost everyone is able to purchase a quality drone for a few tens of euros. The growing number of drones in the sky is calling for a legislation covering this field. EU member states must, each on it's own, legislate laws on the use of drones, because EU has no general legislature on drones. It is important that member states pass such laws that protect human rights and on the other hand enable further development of this field. Upon examination of existing legislative acts in different countries (Slovenia, Austria, Great Britain, France and the USA) a few similarities between different states (flight height limit, minimal distance from people, buildings, etc.) can be found. Using drones with personal data sensors (cameras) we can quickly invade the right of privacy of an individual, therefore it is important that the laws are written in a way that they protect human rights. Besides the dangers of privacy invasion drone usage poses other threats and risks. We have to take in account the dangers that occur in case of a drone crash, as well as the risk of drones being used by criminal organizations for their illegal activities for example drone usage for drug smuggling.
