Abstract:Henry Dunant, idejni oče in eden od ustanoviteljev Mednarodnega odbora Rdečega križa, si leta 1862, ko je izdal knjigo »Spomin na Solferino«, prav gotovo ni mogel predstavljati, da bo organizacija, ki je imela zametke v tako tragičnem dogodku, kot je bila bitka za Solferino leta 1859, 150 let kasneje predstavljala enega glavnih akterjev v mednarodnem humanitarnem pravu. In ne samo to, Mednarodni odbor Rdečega križa je pri svojem delu uspel ohraniti nepristranskost, neodvisnost, nevtralnost in tako zagotavlja enako in pravično obravnavo vseh žrtev oboroženih spopadov ne glede na njihovo nacionalnost ter s tem izpolnjuje vizijo ustanoviteljev Mednarodnega odbora Rdečega križa. Ravno zaradi izjemne vloge v mednarodnem humanitarnem pravu, Mednarodni odbor Rdečega križa danes uživa edinstven status v mednarodni skupnosti. Na podlagi mandata mednarodne skupnosti, je status Mednarodnega odbora Rdečega križa približan mandatu mednarodnih vladnih organizacij, ki so poleg držav, temeljni subjekti mednarodnega prava s polnimi pravicami in obveznostmi ter imajo tudi mednarodno pravno osebnost. Pravice in obveznosti iz podeljenega mandata mednarodne skupnosti pa Mednarodni odbor Rdečega križa, četudi v osnovi še vedno zasebno in torej nevladno organizacijo, ločujejo od statusa drugih nevladnih organizacij. V diplomski nalogi so predstavljene pravne podlage za pridobitev posebnega statusa Mednarodnega odbora Rdečega križa v mednarodni skupnosti. Med temi imajo še posebno težo Ženevske konvencije iz leta 1949 z Dopolnilnimi protokoli, ki predstavljajo hrbtenico mednarodnega humanitarnega prava. V nalogi je prikazano tudi izvajanje aktivnosti Mednarodnega odbora Rdečega križa, na podlagi mednarodnega mandata, v praksi, se pravi v mednarodnih in nemednarodnih oboroženih spopadih ter izvajanje aktivnosti Mednarodnega odbora Rdečega križa ob sodobnih metodah oboroženih spopadov.

Title:SPECIAL SUBJECT OF INTERNATIONAL LAW - INTERNATIONAL COMMITTEE OF RED CROSS
Abstract:It can be said without a doubt that Henry Dunant, one of the founding fathers of the International Committee of Red Cross, could never have imagined when in 1862 publishing the book »A Memory of Solferino« that organization based on such tragic experience as the battle of Solferino in 1895, will today, 150 years later present one of main actors in international humanitarian law. Furthermore International Committee of Red Cross has managed to maintain impartiality, independence and neutrality and by enabling equal and just treatment for all victims of armed conflicts, regardless of their nationality, fulfils the vision of the founders of the International Committee of Red Cross. The exceptional role in international humanitarian law is a foundation for unique position of International Committee of Red Cross. Based on the mandate of international community the status of International Committee of Red Cross is similar to those of international governmental organizations, which along with states represent fundamental subjects of international law having full rights and obligations and international legal personality. Although International Committee of Red Cross is still a private nongovernmental organization it is the mandate of international community and consequently the rights and obligations arising from the stated mandate that differ the International Committee of Red Cross from nongovernmental organizations. The thesis will present legal bases for special status of International Committee of Red Cross in international community. Amongst them the most important Geneva Conventions of 1949 and their Additional Protocols represent the core of international humanitarian law. The theses will also present activities of International Committee of Red Cross based on the mandate of international community in practice i.e. international and non international armed conflicts and modern armed conflicts.
