Title:CHILD MARRIAGES
Abstract:This undergraduate thesis discusses the issue of marriage between children, which has also arisen in Slovenia. In Slovenia, the marriage between children who are younger than 18 is permitted, but only if authorised by the Social Work Centre and if there are justified grounds. A marriage must be entered into consensually, with the expressed amicable will of the future spouses. The will must be true and free, without any coercion. Therefore, the paper mainly stresses the marriage of children in cases when there is a lack of the true will of the future spouses. In some cases, spouses get married because they have been coerced. For this reason, there is also a chapter on forced marriage. Forced and involuntary marriages sometimes occur due to customs and tradition. The paper thus also mainly focuses on the customs and traditions of the Roma community. Forced marriage could be a result of a criminal act, which the paper also describes. Institutions, such as the Social Work Centre, the police, and non-government organisations also play a significant role. The paper focuses on the non-governmental organisation Društvo Ključ, which mainly fights against human trafficking. Furthermore, the paper includes an estimate of the prevalence of marriage between children in Slovenia, provided by the Social Protection Institute of the Republic of Slovenia. In order to reduce the number of marriages between children, measures need to be taken. For this reason, preventive measures are introduced. Moreover, the paper introduces curative measures that are necessary once the victim has already suffered damage.
