Title:PRAVILA O PROROGATIO FORI V UREDBI 1215/2012 IN HAAŠKI KONVENCIJI O SPORAZUMIH O IZBIRI SODIŠČA TER NJUNA MEDSEBOJNA INTERAKCIJA

Abstract:Avtonomija volje strank na področju mednarodnega zasebnega prava omogoča sklenitev prorogatio fori ali sporazuma o izbiri sodišča. Institut, po katerem v praksi posežejo predvsem gospodarski subjekti, je bil v letu 2015 deležen pomembnih prilagoditev. Na ravni Evropske unije je pričela veljati nova Bruseljska uredba, ki med drugim vsebuje prenovljene določbe v zvezi z dogovorjeno pristojnostjo sodišča, prav tako pa je proti koncu leta začela veljati Haaška konvencija o sporazumih o izbiri sodišča. Diplomska naloga obravnava temeljne značilnosti sporazuma o pristojnosti sodišča v obeh pravnih aktih, pri čemer se kot ključni problem zastavlja vprašanje veljavnosti sporazuma v posameznem aktu. Bruseljska uredba vsebuje jasne določbe glede presoje materialne in formalne veljavnosti sporazuma, vendar pa ne definira mednarodnega elementa razmerja, zaradi česar je lahko sporno, v katerih razmerjih je sploh dopustno sklepati prorogacijske sporazume. Na drugi strani je v zvezi s Haaško konvencijo vprašljiv predvsem trenutek, v katerem morajo biti izpolnjeni pogoji za veljavnost sporazuma o izbiri sodišča. Teoretično so možni štirje časovni trenutki: v trenutku sklenitve sporazuma, v trenutku vložitve tožbe, v obeh trenutkih ali pa v enem ali drugem. Haaška konvencija ne rešuje tega vprašanja, prav tako nanj ni mogoče odgovoriti s pomočjo teoretičnih razlag tega pravnega akta. Posledice te nejasnosti lahko rezultirajo v neenotnih odločitvah sodišč, ki bodo odločala skladno s svojim nacionalnim pravom. V zaključnem delu naloge so analizirana prednostna pravila, s katerimi se glede na elemente razmerja rešuje vprašanje konflikta uporabe BU I bis ali Haaške konvencije.

Title:THE RULES OF PROROGATIO FORI IN REGULATION 1215/2012 AND THE HAAGUE CONVENTION ON CHOICE OF COURT AGREEMENT AND ITS MUTUAL INTERACTION
Abstract:In the field of private international law is party autonomy one that enables prorogatio fori or prorogation of jurisdiction. This legal construct is mainly applied in practice by economic entities and was last reviewed in the year 2015. At European Union level a new Brussels Regulation Recast that includes revised directives upon agreed jurisdiction of courts entered into force. Also at the end of 2015 Hague Choice of Court Agreements entered into force. Graduation thesis deals with fundamental characteristics of choice of court agreement in both, Hague Convention and Brussels Regulation, where the question of agreement validity in each legal act arises. On one hand Brussels Regulation sets clear provisions concerning substantive and formal validity, but does not define international element of relation, and it is therefore not clear between what relations is prorogation agreement even permissible. On the other hand is Hague Convention questionable regarding the point in time, when all conditions of prorogation of jurisdiction must be met to be recognized as valid. There are four theoretical options: at the time the agreement is concluded, at the time action is brought, at both times mentioned or at one time or another. Hague Convention does not resolve this matter and theoretical explanations of the instrument are not helpful either. Lack of clarity in this matter can result in inconsistent decisions of courts, as they would decide in accordance with their national law. The last part of the thesis focuses on priority rules analysis. The rules are used to resolve the conflict between Brussels Regulation and Hague Convention particularly with regard to elements of relation.
