Title:Prednosti in slabosti sistema javnega naročanja na Kosovu

Abstract:Sistem javnega naročanja je pomemben segment javne uprave vsake države, ki prinaša dinamične spremembe v okolje, v katerem deluje. Njegova učinkovitost pa je odvisna od ustrezne normativne ureditve in uspešne implementacije. Republika Kosovo je z razglasitvijo samostojnosti ob pomoči mednarodne skupnosti v svoj pravni red vključila tudi zakonodajo s področja javnega naročanja. Sistem javnega naročanja se na Kosovu v zadnjih letih razvija in spreminja ter poskuša slediti evropskim smernicam. Kljub težnjam k ustrezni normativni ureditvi ugotovitve kažejo na številne anomalije sistema, ki so posledica nespoštovanja in kršitev zakonodaje ter zelo razširjene korupcije. V diplomskem delu je predstavljen razvoj sistema javnega naročanja na Kosovu skozi vse reforme in v primerjavi z razvojem in ureditvijo tega področja v Evropi in Sloveniji. S predstavitvijo normativne ureditve smo želeli izpostaviti prednosti in slabosti sistema, ki smo jih ugotavljali tudi na podlagi praktičnih izkušenj in revizorskih poročil. Z obravnavo vprašanj, ali se sistem javnega naročanja na Kosovu razvija v pravi smeri in je primeren za specifično okolje, v katerem se izvaja, in ali sistem javnega naročanja na Kosovu zagotavlja temeljna načela javnega naročanja, smo v kritični analizi sistema podali bistvene ugotovitve.

Title:Strenght and weaknesses of Public Procurement System in Kosovo
Abstract:Public procurement system, which introduces dynamic changes into the environment it operates in while its efficiency depends on the appropriate regulatory framework and successful implementation thereof, constitutes a significant segment of any country's Public Administration. Upon the declaration of its independence, the Republic of Kosovo, assisted by the international community, introduced laws governing the field of public procurement into its legislation. The public procurement system in Kosovo has recently been developing and changing with the attempts to follow the EU guidelines. Despite the country's aspirations for an appropriate regulatory framework, a number of system anomalies resulting from violations and breaches of laws as well as the widespread corruption have been identified. This thesis deals with the development of the public procurement system in Kosovo in relation to the reforms carried out. Thesis also compares the aforementioned development with the development and management of the said field in Europe and Slovenia. The regulatory framework presentation aims at establishing both the system's advantages and disadvantages based on the practical experiences and auditing reports. Additionally, the paper's critical analysis of the system draws tenable conclusions by addressing the questions of whether the public procurement system in Kosovo has been developing appropriately, if it is adequate for its specific environment and whether the system ensures fundamental principles of public procurement.
