Title:Pravni vidiki inšpekcijskega nadzorstva v gostinstvu : diplomsko delo univerzitetnega študija

Abstract:Gostinska dejavnost ima pri svojem poslovanju precej možnosti za izigravanje zakonov in ostalih predpisov, zato je nujno, da država njeno poslovanje nadzira z inšpekcijskimi pregledi. V zadnjih letih so bili rezultati inšpekcijskih pregledov v gostinstvu dokaj zaskrbljujoči. Gostinstvo je dejavnost, ki s svojimi storitvami neposredno vpliva na zdravje ljudi, zato bi morale biti na rezultate inšpekcijskih pregledov te branže še posebno pozorne. V diplomski nalogi sem opisal dejavnost gostinstva, in sicer sem se osredotočil predvsem na restavracije in gostilne, saj je dejavnost zelo obsežna. Opisal sem pogoje za opravljanje gostinske dejavnosti, predstavil sem pravno podlago, ki se je gostinstvo dotika, opisal klasifikacijo NACE in razvoj gostinstva v zadnjih letih. V diplomskem delu je predstavljen inšpekcijski nadzor, razmerje med ZIN in ZUP, načela inšpekcijskega nadzora in dolžnosti ter pooblastila inšpektorja. Opisana je organizacija inšpekcijskih služb. Prav tako sem predstavil poklic inšpektorja, kako do poklica inšpektor posameznik lahko pride in kakšne so njegove odgovornosti. Opisan je inšpekcijski postopek pri zavezancu. Gostinci so po mojem mnenju o svojih dolžnostih slabo informirani. To lahko pripisujemo preobremenjenosti gostinca, nerazumevanju prava ali pa nezanimanju in malomarnosti za pravne podlage delovanja gostinske dejavnosti. Seveda je ob tem treba povedati, da je predpisov, ki določajo pravilno delovanje gostinstva precej in se pogosto spreminjajo. Zaradi takih in drugačnih razlogov za to gostinci v veliki meri kršijo predpise. Z diplomsko nalogo sem analiziral inšpekcijske službe, ki nadzorujejo delo gostincev (tržna inšpekcija, zdravstvena inšpekcija, inšpekcija za varno hrano, veterinarstvo in varstvo rastlin, finančna inšpekcija). Za vse inšpekcije sem preveril, koliko stanejo državo in koliko denarja vrnejo v državno blagajno s svojimi postopki. Poseben poudarek sem namenil finančni inšpekciji, ki tudi najbolj preverja delo gostincev, analiziral sem sivo ekonomijo, delo na črno in opisal tudi nedavno uvedene davčne blagajne. Inšpekcijske službe državo stanejo precej denarja, vendar pa sem z njihovo analizo prišel do zaključka, da se tako finančno kot tudi zaradi javnega dobrega izplačajo in morajo obstajati. Predstavljajo precejšnjo avtoriteto in strah za gostince, kar je v veliki meri dobro, saj se le-ti zato bolj trudijo delovati v skladu s predpisi. Inšpekcijski nadzor je v Republiki Sloveniji dokaj urejen, vendar pa bi lahko še veliko postorili, predvsem , če bi določena pooblastila prenesli tudi na Policijo.

Title:Legal aspects of inspection procedures in catering
Abstract:The hospitality industry inherently contains considerable potential for the circumvention of laws and other regulations. Therefore, it is necessary for the state to oversee hospitality operations through inspection audits. In recent years, the results of inspection audits in hospitality establishments are quite worrying. Since hospitality is an industry whose services have a direct impact on human health, the results of inspections in this industry should be subject to special scrutiny. In this thesis I describe the hospitality industry, focussing mainly on restaurants and pubs, as the industry is very extensive. I describe the conditions for performing hospitality services, present the legal basis of the hospitality industry, describe the NACE and development of the hospitality industry in recent years. The thesis presents inspection audits, the relationship between the Inspection Act and the Administrative Procedure Act, the principles of inspection audits and the duties and powers of inspectors. The organisation of the inspection services is described. I also present the occupation of inspector, how to become an inspector and an inspector's responsibilities. The process of inspecting a party is described. In my opinion, hospitality providers are poorly informed of their duties. This can be attributed to providers' preoccupation, their misunderstanding of the law, or disinterest and lack of regard for the legal bases governing the hospitality industry. Of course, it should be noted that the legislation providing for the proper functioning of the hospitality industry is extensive and is modified frequently. Due to these and other reasons, hospitality providers frequently violate the rules. In the thesis I analyse the inspection services that supervise the work of hospitality service providers (the Market Inspectorate, the Health Inspectorate, the Inspectorate for Food Safety, Veterinary and Plant Protection, the Financial Inspectorate). For all these inspection services, I checked how much they cost and how much they return to the state treasury through the proceedings they conduct. Special emphasis is placed on the Financial Inspectorate, which often inspects hospitality providers; I analyse the informal economy, illegal work and also describe the recently introduced tax cash registers. Inspection services cost the state a lot of money. However, my analysis has allowed me to come to the conclusion that they are worth the money from a financial perspective and that they should also exist for the public good. They present considerable authority and a source of fear for hospitality providers, which is largely a good thing as they are more keen to act in accordance with the regulations. Inspections in the Republic of Slovenia are fairly well-regulated; however, more could be done, in particular, if certain powers were transferred to the police.
