Title:Ugotavljanje količine in izvedenih postavk pri izvajanju gradbene pogodbe

Abstract:V diplomski nalogi sem na začetku predstavil gradbeno pogodbo in pogodbo o nadzoru nad gradnjo ter njuno naravo in značilnosti. Najpomembnejše pravne podlage v zvezi z gradbeno pogodbo so Obligacijski zakonik (OZ), Posebne gradbene uzance (PGU) in pogodbena določila FIDIC. Pri pogodbi o nadzoru nad gradnjo smo predstavili naloge, obveznosti in pooblastila nadzornega inženirja, ki jih ima tekom izvajanja gradbenih del. Osrednji del diplomskega dela zajema materijo, ki je povezana z merjenjem količin in izvedenih postavk pri izvajanju gradbene pogodbe. Pomembno vlogo pri tem ima popis del, ki vsebuje predvidene količine enot za dokončanje gradnje. Ne glede na ocenitev enot, ki so predvidene, mora izvajalec izvesti tolikšno količino enot, kot je potrebno za dokončanje gradnje, ker je gradbena pogodba obligacija rezultata. Kot smo ugotovili, ugotavljanje dejansko izvedenih enot ni vedno bistvenega pomena, ampak je odvisno od tega, za kakšen način plačila sta se pogodbeni stranki dogovorili. Če se naročnik in izvajalec ob sklenitvi gradbene pogodbe dogovorita o plačilu po klavzuli cena na enoto mere, je ugotavljanje, koliko enot je bilo dejansko izvedenih, bistvenega pomena. V nadaljevanju smo raziskali, kdo je zadolžen za meritve, na kakšen način se meritve izvajajo in kdo izmerjene količine potrjuje. V zvezi s tem je zelo pomembno sprotno vodenje gradbenega dnevnika, ki vsebuje poročila o stanju in dogajanju na gradbišču. Pri ceni na enoto mere pa je obvezno tudi vodenje knjige obračunskih izmer, kjer se evidentira količina izvedenih del. Raziskali smo, kakšen pravni učinek ima vpis v gradbeni dnevnik in knjigo obračunskih izmer. V nadaljevanju smo še pogledali, na katerem subjektu je breme dokazovanja, ko število izvedenih enot še ni potrjeno, in tudi, kako je kasneje, ko je število izvedenih enot že bilo potrjeno, pa se določena stranka s tem ne strinja. Pri empiričnem delu smo še pogledali, kako v praksi poteka reševanje sporov in navedli nekaj odločb slovenskih sodišč.

Title:The determination of the quantity and the derived rates during the execution of the construction treaty
Abstract:In my thesis I firstly presented the construction treaty and the treaty of construction surveillance and their characteristics. Crucial legal basis in relation to building contract are Code of Obligations, Special construction usages and FIDIC treaty terms. In the treaty of construction surveillance we presented tasks, duties and authorizations of the surveillance inspector. The main part of the thesis includes data, related to measurement of the quantity and the derived rates during the execution of the construction treaty. In all of this the bill of quantity plays an important part role because it consists of expected quantity of units for the completion of construction. Despite the estimation of the expected units, the contractor must derive such quantity of units as needed for the completion of the construction, because construction treaty is the obligation of result. So the determination of the executed units is not always crucial, but it depends on the kind of payment both parties agreed to. If in the concluding the construction treaty, the client and the contractor agree on paying by the unit-price clause, the determination of the actual derived units is crucial. Furthermore, we investigated, who is responsible for measurements, in which way are measurements conducted and who validates the measured quantities.In relation to this, regular management of the construction blog, which consists of reports on status of the construction site and work, being conducted on the construction site, is very important. In paying by the unit-price the management of the book of measures, where the quantity of the conducted work is evidenced, is obligatory. We investigated the legal effect of records made in the construction blog and the book of measures. We also looked at which subject carries the burden of proving, when the quantity of executed units is not yet confirmed, and how it is later on when the quantity of executed units is confirmed but the client does not agree to the conclusion. In the empirical part of the thesis we viewed at how the settlements are made and we stated some orders of Slovenian courts.
