Abstract:	Pričujoče diplomsko delo obravnava institucijo ombudsmana tako z vidika mednarodnopravne ureditve kot tudi z vidika ureditve v Republiki Sloveniji. Danes je na splošno sprejeta modrost, da je institucija ombudsmana ključna institucija za varstvo človekovih pravic in temeljnih svoboščin. Je eden izmed najpomembnejših civilizacijskih dosežkov. To je razvidno tudi iz tega, da je dobila svoje mesto v ustavnih redih skoraj vseh demokratičnih držav. Eden od korakov k demokraciji v naši družbi je bila uvedba te institucije v naš pravni sistem, v Ustavo RS. Institucija ombudsmana je pokazala v vseh državah zelo dobre rezultate. Ombudsman je namreč samo dopolnilno, neformalno sredstvo za nadzor nad delom upravnih organov. V deželah, ki so sprejele to institucijo poznajo tudi druga, pravna sredstva oziroma sisteme varstva človekovih pravic in temeljnih svoboščin. Prav glavne značilnosti ombudsmana so tiste, ki ga ločijo od vseh ostalih sistemov varstva pravic posameznikov. To so zlasti njegova neodvisnost od izvršilne veje oblasti, neformalni in enostavni postopki, široke pravne pristojnosti ter dostop do vseh informacij, tudi do dokumentov zaupne narave. Njegov uspeh in ugled sta odvisna predvsem od njegovega strokovnega ugleda in njegove sposobnosti komuniciranja z javnostjo. Ombudsman je in naj ostane zanesljiv, neodvisen, avtoritativen dejavnik v vsakdanjem življenju, ki ljudem vsak dan in kadarkoli zagotavlja, da konkretne kršitve njihovih človekovih pravic ne bodo neopažene, prezrte ali pozabljene. Pomembno je namreč, da se napake, kadar se pojavijo, priznajo in, če je le mogoče popravijo. Hitro opravičilo je včasih edino, kar pritožnik pričakuje.

Title:	The Ombudsman in EU and RS
Abstract:	This diploma thesis deals with the institution of the ombudsman, both in terms of international arrangements as well as with regard to the arrangements in the Republic of Slovenia. Today it is generally accepted wisdom that the institution of the ombudsman is a key institution for the protection of human rights and fundamental freedoms. It is one of the most important man-made achievements. This is also evident from this, that it won its place in the constitutional systems of almost all democratic countries. One of the steps towards democracy in our society was the introduction of these institution in our legal system, in the constitution of the RS. The institution of the ombudsman is found in all countries very good results. Ombudsman is only a supplementary, non-formal means of supervision of work of administrative bodies. In countries that have adopted this institution also know the other, legal means or systems of protection of human rights and fundamental freedoms. Also the main features of the ombudsman are those who separate themselves from all the other systems of protection of the rights of individuals. These are in particular its independence from the executive branch, informal and simple procedures, a wide ranging legal powers and acess to all informations, including documents of a confidential nature. His succes and reputation are based mainly on his professional reputation and his ability to communicate with the public. Ombudsman is and should remain a reliable, independent, authoritative factor in everyday life, who ensures to the people every day and at any time that a concrete infringement of their human rights will not be unnoticed, ignored or forgotten. It is important namely, that the errors, when they occur, are recognized and if possible corrected. A quick apology is sometimes the only thing that the complainant expected.
