Abstract:Namen diplomske naloge je predstaviti vpliv odprave subvencioniranja neprofitnega dela tržne najemnine na pravico do socialne varnosti. Subvencioniranje najemnin predstavlja način reševanja stanovanjske problematike v Sloveniji, saj v državi primanjkuje neprofitnih stanovanj, upravičencev pa je vse več. Kot socialna država mora Slovenija svojim državljanom zagotavljati določeno stopnjo socialne varnosti. V letu 2015 je Državni zbor sprejel Zakon o ukrepih za uravnoteženje javnih financ občin (ZUUJFO), ki je posegal v pravice iz Zakona o uveljavljanju pravic iz javnih sredstev (ZUPJS). ZUUJFO je posegal v pravice socialno šibkejših, ki bi jih država na podlagi ustavnih določb morala ščititi. Ukrep je ukinjal pravico do subvencioniranja neprofitnega dela tržne najemnine za najemnike v tržnih in hišniških stanovanjih, ki izpolnjujejo pogoje za pridobitev neprofitnega stanovanja. Sprememba zakonodaje je povzročila položaj neenakosti med upravičenci za najem neprofitnih stanovanj, saj gre za osebe z enakim ekonomskim in socialnim položajem. Posledično je varuhinja za človekove pravice vložila Zahtevo za oceno ustavnosti, saj je ukrep kršil več ustavnih določb, pri čemer se je Ustavno sodišče opredelilo le do kršitve načela enakosti in sporno določbo razglasilo za neskladno z Ustavo Republike Slovenije.

Title:ELIMINATION OF SUBSIDIATION OF THE NON-PROFIT PART OF THE MARKET RENT AND ITS EFFECT ON THE RIGHT TO SOCIAL SECURITY
Abstract:The purpose of this diploma thesis was to outline and present the elimination of subsidization of non-profit market rents and its effect on the right to social security. Subsidization of rents is a method for solving housing problems in Slovenia, since the state is faced with a lack of non-profit housing and an increased number of beneficiaries. As a social state, Slovenia must provide its citizens with a certain degree of social security. In 2015, the Parliament of the Republic of Slovenia passed the Act Regulating Measures Aimed at Fiscal Balance of Municipalities (ZUUJFO) that interfered with the rights arising from the Exercise of Rights from Public Funds Act (ZUPJS). ZUUJFO has infringed the rights of socially threatened, who should be protected by the State based on constitutional provisions. The Act (ZUUJFO) cancelled the right to a subsidization of non-profit market rents for tenants in market rent housing and caretaker's apartments who fulfil the conditions and are eligible for non-profit housings. Change of legislation caused inequalities among beneficiaries for non-profit housing rents, since they all have same economic and social situations. Consequently, the Ombudsman for Human Rights filed a request for constitutional control and evaluation, as the Act violated several constitutional provisions. The Constitutional Court of the Republic of Slovenia issued their opinion only on the subject of principle of equality and declared the controversial provision as non-compliant with The Constitution of the Republic of Slovenia.
