Title:INŠPEKCIJSKI NADZOR IN UKREPI GRADBENE INŠPEKCIJE PRI GRADITVI OBJEKTOV

Abstract:V diplomskem delu je obravnavana in predstavljena pravna ureditev inšpekcijskega nadzora in ukrepov gradbene inšpekcije na področju graditve objektov ter primerjalnopravna ureditev v Republiki Hrvaški. Inšpekcijski postopek, pristojnosti, pooblastila in ukrepi inšpektorjev so po večini urejeni v ZGO-1, ZIN in ZUP, pa tudi v nekaterih drugih zakonih. Dolžnost inšpektorja je, da po uradni dolžnosti in v javnem interesu uvede inšpekcijski postopek in v primeru ugotovljene kršitve izreče sorazmeren ukrep, ki pa pri najtežjih kršitvah pri nelegalni, neskladni ali nevarni gradnji lahko pomeni celo odstranitev objekta ali dela objekta. V primeru, da ga inšpekcijski zavezanec v danem roku ne odstrani sam, se lahko opravi izvršba po drugi osebi, ki pa jo je sicer v taksativno naštetih izjemnih primerih mogoče odložiti. Dosledno upoštevanje predpisov, ki urejajo področje graditve objektov, je torej zaradi posledic, ki jih kršitve prinašajo za posameznika in za širšo družbo, izrednega pomena. Kljub temu pa v vsaki družbi obstaja določen odstotek ljudi, ki predpise vseeno krši. Ravno zaradi tega je ključnega pomena, da so inšpekcijski postopek, pristojnosti, pooblastila in ukrepi gradbenih inšpektorjev v zakonodaji nerazpršeno, pregledno, jasno in nedvoumno oziroma izrecno normirani, saj je lahko le tako omogočeno, da je nadzor gradbenih inšpektorjev nad spoštovanjem zakonodaje učinkovit.

Title:INSPECTION AND BUILDING INSPECTION MEASURES IN BUILDING
Abstract:The diploma thesis discusses and presents the legal regime of the inspection supervision and measures in constructional inspections in the field of building construction, and comparative legal regulations in the Republic of Croatia. The inspection procedure, jurisdictions, authorisations and measures of the inspectors are mostly regulated by ZGO-1, ZIN and ZUP, as well as by some other laws. The inspector’s obligation is to initiate ex officio inspection procedure. In the case any irregularities are found, a proportional measure is imposed; if the construction is illegal, non-compliant or dangerous, it may be required to completely or partially remove the work. In case the person subject to inspection does not remove the work within the deadline, the execution of the inspection measure may be conducted by other person. In some extreme cases listed, the execution can be postponed. Due to the consequences of violations for an individual and the society, consistent compliance of regulations is extremely important. However, in every society there is a certain percentage of people who break the regulations. This is the main reason why inspection procedure, jurisdictions, authorisations and measures of the building inspectors have to be explicitly and clearly stated in the legislation, since this is the only way to provide efficient building inspectors’ supervision.
