Title:Primerjalna analiza ureditve volitev v Evropski parlament (v 28 državah članicah)

Abstract:V diplomskem delu je obravnavana ureditev volitev v Evropski parlament, s poudarkom na primerjavi ureditve med 28 državami članicami. Najprej je predstavljen sam pojem, pomen in razvoj volitev v Evropski parlament. Diplomska naloge je razdeljena na dva sklopa in sicer ureditev volitev v Evropski parlament, kot jo določa evropska zakonodaja in na del, kjer je ureditev določenih vprašanj prepuščena posamezni državi članici. Na ravni evropske zakonodaje je poudarek na določbah o predstavnikih Evropskega parlamenta, na ureditev volilnega sistema in načelu državljanstva Evropske unije in s tem povezane volilne pravice. Drugi del vsebuje primerjalno analizo ureditve volilnega sistema držav članic. Oba dela se v resnici prepletata, saj evropska zakonodaja postavlja temelj, v okviru katerega se lahko zakonodaje držav članic gibajo. Evropska zakonodaja določa le nekatere skupne elemente volitev, kot so petletna mandatna doba parlamenta, omejitev števila vseh poslancev (750 +1) in njihovo razporeditev po državah (najmanj 6 in največ 96 poslancev), dneve za izvedbo volitev (med četrtkom in nedeljo), določbe o nezdružljivosti funkcij in, z zadnjo spremembo Bruseljskega akta, tudi določbo o enotnem – proporcionalnem volilnem sistemu. Ostali volilni elementi, kot so pogoji za kandidiranje na volitvah v Evropski parlament, pogoji za pridobitev aktivne in pasivne volilne pravice, določbe o volilnih enotah, volilnem pragu in formuli za razdelitev volilnih glasov so prepuščeni zakonodajam držav članic. Prav tako se države članice same odločijo o telesu, ki bo potrjevalo mandate in obravnavalo morebitne pritožbe. Najprej se potrditvi mandat poslanca v oviru države članice, nato se izvede potrditev še v okviru Evropskega parlamenta.

Title:Comparative analysis of the elections to the European Parliament ( in 28 Member States )
Abstract:Diploma thesis deals with arrangements for the elections to the European Parliament, focusing on a comparison of the arrangements between the 28 Member States. First, it represents the concept, importance and the development of the European elections. Thesis is divided into two parts firstly the regulation of elections to the European Parliament, as set out in European legislation and secondly in part, that regulates certain issues left to each Member State. In the context of European legislation, the emphasis on the provisions of the representatives of the European Parliament, as regards the regulation of the electoral system and the principle of citizenship of the European Union and the related voting rights. The second part contains a comparison of the electoral system of the Member States. Both parts are in fact intertwined, because European law establishes a kind of foundation, around which Member States can establish their law. European legislation provides only some of the common elements of the election, such as five-year term of the Parliament, the limitation of the number of all deputies (750 + 1) and their distribution by country (minimum of 6 and a maximum of 96 members), the days of holding the elections (between Thursday and Sunday) provisions on the separation of functions and the latest amendment to the Brussels act also provision on a single - proportional electoral system. Other electoral elements, such as conditions for standing as a candidate in elections to the European Parliament, the conditions for the acquisition of active and passive voting rights, the provisions of the constituencies, the electoral threshold and the formula for the allocation of electoral votes is left to the laws of the Member States. It is also the Member States to decide on what state body will be confirmed mandates and deal with any complaints. After confirming the credentials within a Member State, shall be carried out to confirm also within the European Parliament.
