Title:Policijski postopek : diplomsko delo univerzitetnega študija

Abstract:Diplomska naloga zajema obravnavanje policijskega postopka, ki vključuje vsa dejanja policistov, ko opravljajo policijske naloge. Definicijo policijskega postopka najdemo v 8. členu ZNPPol. Na začetku izvajanja policijskega postopka se posamezniku omeji svoboda gibanja, saj mora za čas, ko postopek traja, pri postopku sodelovati. Da se policijski postopek lahko začne izvajati, mora obstajati začetni prag oziroma sprožilna situacija policijskega postopka. Pri vsakem policijskem postopku se pojavi vprašanje, ali je postopek policista pri izvajanju naloge skladen z zakonodajo ter ali je policistovo zakonito ravnanje tudi strokovno, profesionalno, humano, sorazmerno, primerno. Če policist sprožilne situacije nima, tudi nima zakonske podlage za izvajanje policijskih pooblastil. Sprožilna situacija je lahko tudi subjektivno mnenje policista o določeni osebi, kar je lahko razlog za začetek izvajanja policijskega postopka. Pri analizi primera smo spoznali, da je bil zunanji videz osebe vzrok za začetek izvajanja policijskega postopka s strani policista. Policijski postopek je opredeljen preširoko, za druge postopke je temelj izvajanja, vendar pa ravno pri policijskem postopku najdejo tudi subjektivno okoliščino za začetek izvajanja postopka in sprožilna situacija ni potrebna. Policisti morajo pri svojem delu upoštevati osnovna načela za uporabo policijskih pooblastil in osebi, ki se znajde v policijskem postopku, predstaviti njene splošne pravice. Policijski postopek je temelj izvajanja tudi drugih postopkov, kot sta prekrškovni in predkazenski postopek. Dokazni standardi so izrazi stopnje verjetnosti, da se je zgodilo kaznivo dejanje. ZNPPol opredeljuje dva nova dokazna standarda, to sta verjetnost in velika verjetnost.

Title:POLICE PROCEDURE
Abstract:The graduation thesis encompasses a treatment of police procedure that includes all actions of police officers performing police tasks. The definition of police procedure is found in the article 8 of ZNPPol (Law on duties and powers of the police). At the beginning of the police procedure, an individual is limited with freedom of movement, since they have to participate in the procedure for the time of procedure´s duration. In order to start performing a police procedure, there must be an initial threshold or a trigger situation of the police procedure. In every police procedure, there is a question, whether the police officer´s procedure in implementing a task is in accordance with legislation, and whether the police officer´s lawful conduct is also expertly, professional, humane, proportionate, and proper. If a police officer has no trigger situation, they do not have legal basis for implementation of police powers. A trigger situation can also be a subjective opinion of the police officer about a certain person, which can be a reason for the beginning of implementation of a police procedure. In the case analysis, we realised that the external appearance of a person was a reason for beginning of implementation of the police procedure by a police officer. Police procedure is defined too widely; it is a base of implementation for other procedures, but exactly in the police procedure, also subjective circumstance for the beginning of implementation of the procedure is found, and a trigger situation is not necessary. In their work, police officers must consider basic principles for use of police powers, and present basic rights to the person in a police procedure. Police procedure is also a base of implementation of other procedures, such as infringement and pre-litigation procedure. Standards of proof are expression of degree of probability that a punishable offence occurred. ZNPPol defines two new standards of proof, namely probability and high probability.
