Title:AVTONOMIJA STARŠEV IN OTROK V RAZMERJU DO DRŽAVE S POUDARKOM NA OSNOVNOŠOLSKEM IZOBRAŽEVANJU

Abstract:Otroci so ranljiva človeška bitja, ki so od odraslih odvisna tako fizično kot čustveno. Z veljavno zakonodajo, ki poudarja otrokove pravice in uresničevanje otrokove koristi, je po črki zakona sicer zagotovljena zaščita in skrb za otroke, vendar je vse preveč nepravilnega razumevanja oz. tolmačenja vrednostnega pojma otrokove koristi, s tem pa prihaja do kršenja temeljnih otrokovih pravic, ki so zagotovljene tako z domačo pozitivno zakonodajo kot z ratificiranimi mednarodnimi konvencijami. Pojem avtonomije družine je varovan s pravico do družinskega življenja. Kljub temu pa ne gre zanemariti dejstva, da so lahko največje krivice in kršitve osnovnih otrokovih pravic storjene prav za zidovi družinskega življenja; v nekaterih primerih gre za navzven idilične družine, ki predstavljajo lažni občutek harmonije in naklonjenosti med družinskimi člani. Država je takrat upravičena, da preko svojih organov poseže v tako nezdravo družinsko celico in stori vse, da zavaruje otrokove koristi in izkaže težnjo k uresničitvi zagotavljanja otrokovih pravic. Tudi na področju šolstva prihaja v zadnjih letih do vse preveč pogostih kršitev že zapisanih človekovih pravic. Tako se sodišča, upravni organi in inšpekcijske službe vse pogosteje srečujejo s primeri kršenja osnovnih človekovih pravic in sicer v razmerju starši – šola, otrok – šola oz. celo starši – otrok. Pravna ureditev je z obsežno zakonodajo sicer uredila področje izobraževanja in vzgoje, vendar obstajajo v praksi še vedno precej nedovršeni in nerazjasnjeni pojmi in tudi slovenska sodišča včasih (nevede?) pozabljajo upoštevati otrokovo korist.

Title:PARENTAL AND CHILDREN'S AUTONOMY IN RELATION TO THE STATE WITH AN EMPHASIS ON PRIMARY EDUCATION
Abstract:Children are vulnerable human beings who depend on adults, both physically and emotionally. The current legislation, which emphasizes the child’s rights and the exercise of the child’s interests, guarantees the protection and care for children. However, the concept of child’s interests is often misunderstood or misinterpreted, which thus leads to violation of fundamental children’s rights guaranteed both by domestic positive law as also by ratified international conventions. The concept of family autonomy is protected by the right to family life. Nevertheless, one should not overlook the fact that the greatest injustices and violations of the basic children’s rights may still be committed behind the walls of family life; in some cases, families appear idyllic outwardly, which represents a false sense of harmony and affection between family members. The State is then entitled to intervene between such an unhealthy family unit through State bodies and to do everything to protect the child’s interests and demonstrates a tendency towards the realization of ensuring children's rights. Recently, even in the field of education, there have been significant violations of enshrined human rights. Thus, the courts, administrative authorities and inspection services are increasingly confronted with cases of violations of basic human rights in proportion parents - school, child - school or. even parent - child. Notwithstanding the field of education and upbringing is regulated by vast legislation, in practice, there still exist quite imperfect and vague concepts and, furthermore, Slovenian courts sometimes (unwittingly?) forget to take into account the child's interests.
