Abstract:V diplomskem delu Varstvo kupcev psov želim predstaviti problematiko omenjenega področja. Vedno več ljudi se namreč odloča za nakup psa kot hišnega ljubljenčka, vendar so kot kupci, velikokrat žrtev preprodajalcev psov oziroma nakupa psa, ki nima ustreznih dokumentov. V Sloveniji ni na voljo področnega zakona ali uredbe, ki bi strnjeno urejal pravice in obveznosti tako prodajalca kot kupca psov, zato je potrebno izhajati iz določb Obligacijskega zakonika kot splošnega zakona, Zakona o zaščiti živali, Zakona o varstvu potrošnikov in pravilnikov Kinološke zveze Slovenije. V njih so opredeljene pravice in dolžnosti vzrediteljev, prodajalcev, pa tudi kupcev psov. V mnogih državah so pravice kupca v primeru nakupa hišnih živali zelo dobro in natančno določene s tako imenovanim »lemon law« specialnim zakonom na nacionalni ravni. Podobna ureditev bi bila smiselna tudi pri nas. Bistvenega pomena ob nakupu psa je tudi prodajna pogodba, ki mora biti sestavljena tako, da varuje interese obeh pogodbenih strank. Sklenitev dobre pogodbe, ki varuje obe stranki, je bistvenega pomena za razmejitev odgovornosti med eno in drugo stranko pogodbe. Drugi problem, na katerega prav tako opozarjam v nalogi, je vzreja psov. Z vzrejo se v Sloveniji lahko ukvarja vsak, ki pridobi vzrejno dovoljenje za psa, nikjer (v nobenem pravilniku) pa ni predvideno, kakšna znanja naj bi imel vzreditelj psov in kakšnim pogojem naj bi vzreditelj zadostil. Menim, da bi bile stvari veliko bolje urejene in tudi pregledne, če bi na nivoju države pripravili področni akt, ki bi podrobno uredil medsebojna razmerja med prodajalcem in kupcem za primer nakupa psa ali druge domače živali.

Title:DOG BUYER'S PROTECTION
Abstract:The purpose of the diploma thesis The legal protection of dog buyers is to address issues connected with the subject. Today, more and more people decide to purchase dogs as pets, but are, as buyers, often victims of dog traffickers or buy dogs that don't have proper documents. In Slovenia, there is no special act that governs the rights and obligations of dog sellers and buyers, so we have to look at the provisions of the Code of Obligations as a general law, the Animal Protection Act, the Consumer Protection Act and the Cytological Association of Slovenia, in which the rights and obligations of breeders, sellers and buyers of dogs are identified. In many countries, the rights of the pet buyers are precisely set in the so called »lemon laws«, a special act at the national level. I believe that it would sensible to adopt similar acts in Slovenia. When buying a dog, it is crucial to conclude a sales contract, which should protect the interests of both parties. This is of a particular importance for the delimitation of responsibility of both parties. The others issue is the breeding of dogs. In Slovenia, anyone who obtains a breeding permit for a dog can become a dog breeder, but there are no rules that define the knowledge or expertise the breeder needs and what conditions should he meet. I believe the area would be more stable and more easily manageable, if a special act regulating the field is drawn up at the state level, which would precisely regulate the relations between the buyer and seller of dogs or other domestic animals.
