Title:PRIMERJAVA ZAKONSKE ZVEZE PO KANONSKEM IN CIVILNEM PRAVU

Abstract:Kanonsko in civilno pravo v nekaterih pogledih podobno obravnavata zakonsko zvezo, to bi lahko rekel predvsem za pogoje, ki jih postavljata za sklenitev zakonske zveze in pri skrbi za otroke, ki so posebej zaščiteni v obeh sistemih, vendar se zelo hitro pokažejo velike razlike, ki izhajajo predvsem iz osnovnega dejstva: kaj za katero pravo pomeni poroka. Za kanonsko pravo je to nekaj svetega, zakrament, za civilno pravo pa je to pogodba, ki jo lahko razdre katerakoli od strank skoraj brez razloga. Kanonsko pravo na to zvezo gleda tudi z duhovne plati in svetuje, kako se na poroko pripraviti in kako živeti v zakonski zvezi. V vsakem primeru se trudi, da bi se zakonska zveza obdržala, tudi ko odnosi med zakoncema niso takšni, kot bi morali biti. Nasprotno od tega pa je civilno pravo bolj »hladno«, saj gleda na zakonsko zvezo kot na skupek pravic in dolžnosti obeh zakoncev, ki si lahko kadarkoli premislita in končata to pogodbo, ki sta jo sklenila. Zato se civilno pravo (in posledično ZZZDR) tudi veliko bolj posveča odnosom in razmerjem, ki nastopijo po prenehanju zakonske zveze. Zakonik cerkvenega prava ne pozna razveze kot takšne, je pa pod izjemno strogimi pogoji mogoče ugotoviti in razglasiti ničnost zakonske zveze od začetka, kar pomeni, da nikoli ni obstajala.

Title:COMPARISON OF THE INSTITUTION OF MARIAGE IN CANON AND CIVIL LAW
Abstract:Canon and civil law in some aspects regard marriage in a similar way. This primarily refers to the conditions they impose on marriage and care of children, who are particularly protected in both of the systems, but great differences quickly arise from the basic fact - what marriage means in either of these laws. For the canon law marriage is something sacred, a sacrament, for the civil law on the other hand it represents a contract that can be terminated by either of the parties without a reason. In canon law one of the aspects is also a spiritual one, since it advises how to get ready for marriage and how to live in a marriage union. In every aspect it is dedicated to keeping the spouses together even when the relationship between them is far from what it should be. Contrary to that civil law is much more realistic, since from its point of view marriage is a set of rights and duties of both spouses that can at any given point in time change their minds and terminate the contract between them. That is why civil law (and consequently ZZZDR) is concentrated a lot more on the relationships that occur after the termination of marriage. Code of Canon Law does not recognize divorce as such but under very strict conditions there is a possibility of establishing and declaring the nullity of the marriage from the beginning which actually means it never even existed.
