Title:PROBLEMATIKA DOKAZOVANJA IN DOKAZNEGA BREMENA V KAZENSKEM IN PREDKAZENSKEM POSTOPKU

Abstract:V diplomski nalogi je predstavljeni potek dokazovanja v kazenskem in predkazenskem postopku v Sloveniji. Izpostavljenih je nekaj ključnih problemov, ki se pojavljajo tekom celotnega postopka dokazovanja in predvidene rešitve, ki bi pripomogle k izboljšanju le-tega. Dokazovanje je zahtevno procesnopravno opravilo, saj združuje uporabo dejanskih ugotovitev in pravnih norm ter obsega zbiranje, izpeljavo in presojo dokazov. Dokazno breme v našem kazenskem postopku nosi upravičeni tožilec, ki oceni ali je podan utemeljen sum, da je določena oseba storila kaznivo dejanje. Izjemoma pa pride tudi do obrnjenega dokaznega bremena, kjer je dokazno breme na obdolžencu. Ker je dokazovanje eno izmed ključnih dejanj celotnega kazenskega postopka je zelo pomembno, da so vsi dokazi zbrani zakonito in da pri odkrivanju kaznivih dejanj ni prišlo do kršenja človekovih pravic. S prvo fazo dokazovanja kaznivih dejanj se srečajo policisti pri odkrivanju kaznivih dejanj v predkazenskem postopku, ko s formalnimi in neformalnimi preiskovalnimi dejanji zbirajo dokazno gradivo. Da bi dokazni postopek bil učinkovit, mora biti zbranih in izvedenih dovolj dokazov, da se razjasni dejansko stanje in sicer morajo dokazi biti zbrani na zakonit način, saj prav nezakonito pridobljeni dokazi dvigajo veliko prahu v javnosti ter mečejo slabo luč na sodstvo, čeprav krivda večino krat ni v sodstvu, ampak v organih, ki so zbrali dokaze na nezakonit način. Cilj diplomske naloge je pojasniti postopek dokazovanja in dokaznega bremena ter poiskati rešitve, ki bi pripomogle k izboljšanju našega sistema, da bo le ta zanesljivejši, učinkovitejši ter pravno bolj varen.

Title:THE PROBLEM OF PROOF AND THE BURDEN OF PROOF IN CRIMINAL PROCEDURE AND PRE-TRIAL
Abstract:This thesis presents a course of evidence in criminal and pre-trial proceedings in Slovenia. Some of the key problems that occur during the whole process of proving are exposed. There are also given some solutions that would contribute to the improvement of it. Proving is a challenging procedural task, it combines the use of factual findings and legal norms, as well as comprises the collection, the derivation and assessment of the evidence. The burden of proof in our criminal procedure bears the public prosecutor, so he can assess whether there is a reasonable suspicion that a certain person has committed a criminal offense. A reverse onus is possible on exceptions, which would concern a shift in burden of proof onto a defendant. Because proving is one of the key actions of the entire criminal procedure, it is very important that all the evidence is collected legally and that in the detection of crime, there are no violations of human rights. Police officers in pre-trial proceedings meet with the first phase of proving crime in crime detection, when they are gathering evidence with formal and informal investigative activities. For effective evidence collection, it must follow procedure and be conducted in a way where the evidence will clarify the facts. The evidence must be collected in a legal manner, because illegally obtained evidence by its admission, can endanger trial fairness, conceivably throwing bad light on the court, even though the fault most times is not on the court, but on the authorities which gathered evidence in an illegal practice. The aim of this thesis is to clarify the procedure of evidence, as well as the burden of proof, and to find solutions that would help to improve our system, so that it would be more reliable, more efficient and more legally secure.
