Title:ODVETNIK PO LETU 1850 V SLOVENSKEM PRAVNEM PROSTORU

Abstract:V svoji diplomski nalogi sem predstavila razvoj odvetništva na Slovenskem po letu 1850. Zaradi boljšega in celostnega vpogleda bralca sem uvodoma opisala še zametke in razvoj do tega leta. V prvem delu sem se osredotočila na začetek razvoja, tj. od antične dobe, urejenosti v habsburški monarhiji, do sprejema pomembnega predpisa za odvetništvo leta 1868 – Odvetniški sodni red. Na Slovenskem Odvetniški sodni red pomeni pomembno prelomnico, saj predstavlja začetek organiziranega delovanja odvetništva. Kot »žrtev« oblastnih predpisov o podeljevanju advokature lahko izpostavim dr. Franceta Prešerna, kar sem povzela v posebej njemu namenjenem poglavju. Od reda dalje so se zakoni na tem področju spreminjali in dopolnjevali. V Sloveniji trenutno velja Zakon o odvetništvu iz leta 1993, z nadaljnjimi spremembami. Zadnja takšna sprememba je bila 30. 6. 2016. Ker vsakokratna družbeno-politična klima odločilno vpliva na predpise in odseva smernice oblasti, sem za obdobje med in po svetovnima vojnama na kratko povzela in opisala zakone, saj so pomembno vplivali na stopnje razvoja odvetništva vse do današnje stopnje. Prav tako je za odvetnika pomembno, da se vseskozi izobražuje, pozna osnove komuniciranja in nastopanja ter da s svojim vedenjem in ravnanjem ne škoduje ugledu odvetništva. Njegovo celostno podobo zaokrožuje tudi njegova retorika, pravila o posredovanju dovoljenih informacij o primerih in način oblačenja, kar sem predstavila v drugem delu te naloge. Odvetnik ni ločen od ostalega družbenega življenja, ampak je še kako vpet v človekovo življenje. Vsled tega so nekateri v pravu izobraženi pesniki in pisatelji na podlagi pravne prakse dobili dober vir za svoja literarna dela. Pomembno osebnost v advokaturi je predstavljala dr. Ljuba Prenner, ki je bila odvetnica in pisateljica. Njo in nekaj nam bolj poznanih in vidnejših literatov sem predstavila v zadnjem delu te naloge.

Title:LAWYER AFTER 1850 IN THE SLOVENIAN LEGAL AREA
Abstract:In my diploma thesis I presented the development of advocacy in Slovenia after the year 1850. In order to provide a better and overall insight into the topic, I firstly described the origins and the development of the advocacy. In the first part I focused on the beginning of the development, that is, from the antique era, through the regulations in Habsburg monarchy to the passing of the important advocacy regulation in 1868 – the juridical order. It is a turning point in Slovenia because it presents the beginning of the organised working advocacy. I can point out France Prešern as a “victim” of the authorial regulations for licensing legal practices, which I summarized in the chapter dedicated to him. Since the juridical order from 1868 the laws in this field have been changing and developing. Currently in Slovenia the Law of Advocacy from the year 1993 is still in force with its further changes. Such last change was on the 30th of June 2016. Since every time social and political atmosphere, which reflects the authorial guidelines, has the main impact on the regulations, I summarized and described the laws of the period between and after the two world wars. Furthermore, these laws also significantly affected the stage of advocacy development until today. It is also of great importance for a lawyer to be continuously educating, knowing the basics of communication and performing, and keeping his manners and behaviour in order not to harm advocacy’s reputation. The lawyer’s overall image also consists of his rhetoric, thee regulations of mediating permitted information of the cases, and the way of clothing as presented in the second part of my diploma thesis. A lawyer cannot be separated from the rest of the society; moreover, he is tightly integrated to the humans’ lives. Accordingly, some poets and writers holding a degree in law got the inspiration for their writing from practicing the law. Dr. Ljuba Prenner, who was a lawyer and a writer, presented an important figure in advocacy. She and some more known and significant Slovene writers are presented in the last part of my diploma thesis.
