Title:POJASNILNA DOLŽNOST ZDRAVNIKA ANESTEZIOLOGA

Abstract:Diplomska naloga govori o medicinsko-pravnih pogledih na pojasnilno dolžnost zdravnika anesteziologa in analizira dejavnike, ki vplivajo na njo. Analiza je opravljena glede na slovensko zakonodajo, v kateri je izpostavljen Zakon o pacientovih pravicah (ZPacP) in prakso opisane doktrine v skladu z anesteziološkimi standardi. Vključuje določene globalne poglede in možne rešitve za izboljšanje dejanske realizacije v praksi. Predstavljeni so etični, pravni in strokovni vidiki pojasnilne dolžnosti in nanjo vezane zavestne privolitve ali odklonitve zdravljenja. Ob enem predstavlja konstruktivno kritiko na zdravstveni sistem in samo politiko ter služi splošnemu ozaveščanju. Predstavlja specializirano obliko pravice do samoodločanja, ki je odraz človekove avtonomnosti. V diplomskem delu so predstavljeni, zapleti, posebni primeri in stik s sodno prakso povezano z odgovornostjo poklica zdravnika anesteziologa. Izpostavlja se aktualen problem nedoločenosti časovnega okvira pojasnilne dolžnosti povezane s kadrovsko in prostorsko stisko v bolnišnicah. K diplomski nalogi so priloženi privolitveni obrazci, ki se predložijo pacientu za veljavno privolitev v postopek zdravljenja z anestezijo.

Title:INFORMED CONSENT AND THE ANAESTHESIOLOGIST
Abstract:The thesis addresses medical-legal views on the duty of an anaesthesiologist and analyses the factors that influence it. The analysis is performed according to the Slovenian legislation, which underlines The Patient Rights Act (ZPacP) and practice in accordance with the standards and doctrine of anaesthesiology. It includes certain global perspectives and possible solutions to improve the actual realization in practice. Featured are the ethical, legal and professional aspects in connection with informed consent or treatment refusal. It represents a constructive criticism of the health system and policy and serves the rising of general awareness. It is a specialized form of the right to self-determination, which is a reflection of human autonomy. The thesis presents complications, specific cases and contact with the case law related to the liability of the profession, such is anaesthesiologist. It highlights the current problem of indeterminate timeframe of applying informed consent, associated with overcrowded hospitals and lack of anaesthesiologists. The thesis includes the written forms of informed consent, which are in practice submitted to the patient in Slovenia for a valid consent in treatment with anaesthesia.
