Abstract:V zadnjem času se v Sloveniji in tudi v drugih sodobnih demokracijah, temelječih na liberalnih načelih, pogosto preizprašuje (ne)upravičenost poseganja države v življenja njenih državljanov, v svobodo oziroma svoboščine posameznika. V primerih slovenskih referendumov, ko je oblast ignorirala jasno izraženo voljo ljudstva, ali ko jo je spoštovala, četudi je to pomenilo zavrnitev izenačenja pravic manjšini, se zastavlja vprašanje, s kakšnimi upravičljivimi razlogi bi bila takšna dejanja dopustna. Zdi se, da v Sloveniji ideje liberalizma vse bolj bledijo oziroma so vse bolj zapostavljene. V diplomskem delu ugotavljamo, katere so svoboščine oziroma družbene vrednote državljana, kako ravnati, kadar svoboščine trčijo in v katerih primerih bi lahko bila prisilna ravnanja države upravičena. Torej, kašna mora biti vloga države, da lahko njeni državljani živijo srečno in dobro življenje. Rawlsova teorija pravičnosti in Gausov koncept minimalne nevtralnosti nakažeta podlago srečnemu in dobremu življenju državljanov, saj prva ureja enakopravnost državljanov in porazdelitev družbenih dobrin, druga pa določa vlogo države v življenju njenih članov. Ob primerni družbeni pogodbi in upoštevanju le te o nam lahko J. Rawls, G. F. Gaus in W. A. Galston v veliko pomoč pri, na neki način, vnovičnem vzpostavljanju ideje liberalnosti v Sloveniji.

Title:THE PROBLEM OF THE MINIMAL NEUTRALITY CONCEPT IN LIBERALISM
Abstract:Recently, in Slovenia as well as in other modern democracies, based on liberal principles, the (un)justification of government intervention in the lives of its citizens, in freedom and individual freedoms, has often been questioned. In the case of Slovenian referendums, when the government ignored the clearly expressed will of the people, or when it observed it, even if that meant rejecting the equalisation of the rights of minorities, the question is, what justifiable reasons make such actions admissible. It seams that in Slovenia, the ideas of liberalism increasingly fade, or are increasingly neglected. In this writing we determine the freedoms and social values of citizens, how to act when freedoms collide, and in which cases coercive conduct of the state is justified. What should be the role of the state, so its citizens can live a good and happy life? Rawls' theory of justice and Gaus's concept of neutrality give a minimum base for a good and happy life of the citizens, since the first regulates the equality of the citizens and the distribution of social goods, while the second determines the state's role in the lives of its members. Having an adequate social contract and respecting it, considering the ideas of J. Rawls and G. F. Gaus, can be great help to in a way, re-establish liberal ideas in Slovenia.
