Abstract:Podelitev državljanstva spada pod izključno pristojnost posamezne države, ki sama določi tudi postopke in pogoje za pridobitev državljanstva. Danes so razširjeni trije sistemi za pridobitev državljanstva ter različne kombinacije med njimi. Države uporabljajo te sisteme na različne načine, kar lahko privede do konfliktov, kot je dvojno državljanstvo in pojav oseb brez državljanstva. Osebe brez državljanstva oz. apatridi obstajajo že od nekdaj, s prvo definicijo pa se srečamo leta 1954 v Konvenciji o statusu oseb brez državljanstva. Gre za osebe, ki nimajo državljanstva nobene države oziroma jih nobena država ne priznava za svojega državljana. Apatridnost pa lahko povzročijo tudi drugi dejavniki ne zgolj neusklajenost med nacionalnimi zakonodajami držav. Položaj in pravice oseb brez državljanstva ureja Konvencija o statusu oseb brez državljanstva iz leta 1954, ki je najbolj pomemben dokument na tem področju. Leta 1961 pa je bila sprejeta še Konvencija o zmanjšanju števila oseb brez državljanstva, ki se osredotoča predvsem na odpravo in izognitev nadaljnjemu pojava apatridnosti. Republika Slovenija je podpisnica zgolj Konvencije iz leta 1954, ni pa pristopila h Konvenciji iz leta 1961.

Title:STATUS OF STATELESS PERSONS
Abstract:Granting citizenship falls under the jurisdiction of each country and the country itself determinates the procedures and conditions for obtaining the citizenship. Nowadays there are three systems to obtain citizenship and different combinations between them. Countries use these systems in different ways, which can lead to conflicts, such as dual citizenship and statelessness. Stateless persons or statelessness have existed for a long time but the first definition of a stateless person can be found in the Convention relating to the Status of the Stateless Persons from 1954. A stateless person is a person who is not considered a citizen by any country nor has a citizenship of any country. Statelessness can also be caused by other factors not only by mismatch between the national laws of the countries. Status and the rights of stateless persons are governed by the Convention relating to the Status of the Stateless Persons from 1954, which happens to be the most important document in this field. The Convention on the Reduction of the Statelessness was adopted in 1961 and its main focus is the elimination and reduction of statelessness. The Republic of Slovenia signed the Convention from 1954 but did not sign the Convention from 1961.
