Abstract:
Diplomsko delo obravnava pravno varnost, ki je ena izmed temeljnih pravnih vrednot s pomembno vlogo v pravni državi. Pravna varnost s svojo zahtevo po predvidljivem in zanesljivem pravu ter zahtevo po stabilni zakonodaji s trajno in stalno vsebino splošnih pravnih aktov, ustvarja zaupanje v pravo. Zahteva pravne varnosti po stabilni zakonodaji prihaja v konflikt z zahtevo pravne države po prilaganju prava spremembam družbenih razmerij. Diplomsko delo obravnava ta konflikt v zvezi z varstvom pričakovanih pravic pred arbitrarnim spreminjanjem zakonodaje.

Title:
LEGAL CERTAINTY AND PROTECTION OF ANTICIPATED RIGHTS
Abstract:
The thesis of this diploma deals with legal certainty, which is one of the fundamental legal values with a significant role in the rule of law. Legal certainty with its requirement for predictable and reliable law and its requirement for stable legislation with a durable and permanent content of general legal acts, creates trust in the law. The requirement of legal certainty for stable legislation comes into conflict with the requirement of the rule of law for law to adapt to changes in social relations. The thesis deals with this conflict in connection to the protection of anticipated rights from arbitrary legislation modifications.
