Title:Enotni mehanizem za reševanje bank - drugi steber bančne unije

Abstract:Drugi steber bančne unije oz. enotni mehanizem za reševanje (SRM) je del evropske bančne unije, ki je zasnovana z namenom enotnega nadzora bančnega sistema, enotne ureditve reševanja bank in uvedbe enotnega sistema jamčevanja za vloge na območju evropske monetarne unije. Direktiva o vzpostavitvi okvira za sanacijo ter reševanje kreditnih institucij in investicijskih podjetij (BRRD), prekinja vzročnost naraščajočih državnih dolgov kot posledico reševanja bank iz sredstev proračunov držav članic (t. i. bail-out). Ta princip reševanja je zamenjal princip s posegom na sredstva upnikov banke (t. i. bail-in). Slednji se je kot priporočljiv sprejel na mednarodni ravni v okviru nezavezujočih pravil Odbora za finančno stabilnost (angl. Financial Stability Board) pri Banki za mednarodne poravnave (angl. Bank for International Settlements). Uredba o enotnem mehanizmu za reševanje (SRMR), osrednji pravni akt enotnega mehanizma za reševanje (SRM), nadgrajuje BRRD z enotnim odborom za reševanje (SRB) in skladom (SRF), ki ga SRB upravlja. Drugi bančni steber tako predstavlja centralizacijo pristojnosti glede odločanja o reševanju propadajočih bank na ravni institucij in organov EU.

Title:Single Resolution Mechanism - Second Pillar of the Banking Union
Abstract:The second pillar of the banking union forms a part of the European banking union, which has been devised to provide common supervision over the banking system, common bank resolution regulation and the guarantee scheme for deposits in the Eurozone and other voluntary participating EU member states. Bank Recovery and Resolution Directive (BRRD) ends the causality between growing sovereign debt as a consequence of member states using public funds to rescue banks (so called "bail-out"). This bank rescue principle has been replaced with the principle of tapping the assets of bank's creditors (so called "bail-in"). The latter has been adopted as recommended within the non-binding rules developed by the Financial Stability Board with the Bank for International Settlements. Single Resolution Mechanism Regulation, the central legal document of the Single Resolution Mechanism (SRM), builds on the BRRD by introducing a central resolution authority (Single Resolution Board - SRB) and the resolution fund managed by SRB. Second banking pillar thus represents the centralization of powers on the decisions on rescuing failing banks with EU institutions and bodies.
