Abstract:Nastanek gospodarske krize je že pred leti povzročil spremembe gospodarstva, ki se odražajo tako v Republiki Sloveniji, kot v ostalih državah članicah Evropske Unije še danes. Najbolj so te spremembe občutile nestabilne gospodarske družbe, ki jih je kriza pripeljala do velikega števila odpuščanj delavcev iz poslovnih razlogov oziroma kolektivnih odpustov. Gospodarske družbe morajo v teh primerih ravnati v skladu z določili o kolektivnih odpustih, ki jih na mednarodni ravni ureja Direktiva Sveta 98/59/ES o približevanju zakonodaje držav članic v zvezi s kolektivnimi odpusti, na nacionalni ravni Republike Slovenije pa to ureja Zakon o delovnih razmerjih, v členih od 98 do 103. V diplomskem delu je najprej predstavljena ureditev kolektivnih odpustov po Direktivi Sveta 98/59/ES s sklicevanjem na sodno prakso Sodišča Evropske Unije, ki je preko svojih sodb podalo pomembno razlago posameznih določb ter široko opredelilo posamezne pojme omenjene Direktive. To razlago določb in pojmov morajo upoštevati vse države članice Evropske Unije, tudi Republika Slovenija. Na koncu je predstavljena še slovenska pravna ureditev kolektivnih odpustov, s pomočjo sodne prakse slovenskih sodišč.

Title:CONCEPT OF COLLECTIVE REDUNDANCIES
Abstract:The emergence of the economic crisis a few years ago resulted in changes in the economy, which reflected both, the Republic of Slovenia and also other Member States of the European Union. Most of this changes were felt the most by unstable undertakings, which led to large number of dissmissals of workers for bussiness reasons also known as collective redundancies. In these case, undertakings must comply in accordance with Articles of collective redundancies, which are internationally regulated with Council Directive 98/59/EC on the approximation of the laws of the Member States relating to collective redundancies and nationally regulated Republic of Slovenia by Employment Relationships Act in Articles from 98 to 103. In the thesis you can find firstly the regulation of collective redundancies by Council Directive 98/59/EC with reference to the case-laws of Court of Justice of the European Union, which, throughtout its judgements give out an important interpretation of specific Articles and broadly defined individual terms of the said Directive. This interpretation of the Articles and concepts must be taken into laws of all the Member States of the European Union, including Republic of Slovenia. In the end the thesis presents also the Slovenian legal regulation of collective redundancies with the help of case-laws of Slovenian courts.
