Title:Konkretizacija pravnega načela prepovedi zlorabe v civilnem pravu

Abstract:Pravno načelo prepovedi zlorabe je eno od osrednjih in najstarejših pravnih načel, ki izhaja iz povezanosti subjektov pravic v družbene skupnosti in neizogibnega konflikta interesov. Načelo prepovedi zlorabe pravice je temeljno načelo civilnega prava, ki je kot načelo splošnega dela civilnega prava obravnavano v Obligacijskem zakoniku ter Stvarnopravnem zakoniku. Pravica je pravno zavarovana možnost, da subjekt pravice na določen način ravna, pri čemer je cilj pravice pravno zavarovan interes. Teorije o zlorabi pravice so se razvijale v smeri prepovedi zlorabe pravice z namenom omejevanje individualističnega koncepta absolutne pravice ter širile vlogo in namen pravice na njeno družbeno funkcijo, ki je nad in zunaj same pravice. Slovenskemu pravnemu redu ustreza splošna prepoved zlorabe pravice, ki temelji na objektivnih merilih, neodvisnih od subjektove krivde. Pri zlorabi pravice prihaja do prepletanja pravno dopustnega in prepovedanega, ker temelji izvrševanje pravice na pravnem upravičenju. Pravni red prepoveduje zlorabo pravice. Uporabnost pravnih načel je odvisna od operacionalizacije v splošnih in abstraktnih pravnih pravilih ter upoštevanja in razvoja v pravni teoriji in praksi. Konkretizacija načela prepovedi zlorabe pravice se uresničuje v sodni praksi s konkretnimi pravnimi pravili v sodnih odločbah, katerih vrednostno merilo je načelo prepovedi zlorabe pravice.

Title:Concretization of the legal principle of prohibition of abuse of rights in civil law
Abstract:Legal principle of prohibition of abuse of rights is one of the main and oldest legal principles that arises from the integration of subjects of rights into social communities and from unavoidable conflict of interests. Principle of prohibition of abuse of rights is a fundamental principle in civil law which is as a principle of the general part of the civil law treated in the Code of Obligations and Law of Property Code. A right is legally protected possibility which enables that the subject of right acts in a certain way where the objective of a right is legally protected interest. Theories of abuse of rights were developing in the direction of prohibition of abuse of a right with intention of limiting the individualistic concept of absolute right and were broadening the role and purpose of the right to its social function which is above and beyond the right itself. The Slovenian legal system is appropriate for a general prohibition of abuse of a right that is based on objective criteria independent of subject's guilt. Abuse of a right comprises intertwining of legally permissible and prohibited because the exercise of the right is based on legal entitlement. Legal system prohibits abuse of a right. Usefulness of legal principles depends on the operationalization in general and abstract legal rules and consideration and development in legal theory and practice. Concretization of the principle of prohibition of abuse of a right is exercised in judicial practice using concrete legal rules in judgments whose value criterion is principle of prohibition of abuse of a right.
