Title:STEČAJ NA SLOVENSKEM OD LETA 1868 DO DRUGE SVETOVNE VOJNE

Abstract:Stečaj je splošna generalna izvršba nad premoženjem dolžnika zaradi namena poplačila njegovih upnikov. Začetki instituta stečaja segajo v rimsko dobo. Prvi moderni stečajni zakoni so bili sprejeti v času industrijske revolucije. Obdobje od 1868 do druge svetovne vojne so na slovenskem stečaj in s stečajem povezane postopke urejali avstrijski »Die Konkursordnung« ali Konkurzni red iz leta 1868, Konkurzni (stečajni) zakon za Kraljevino Jugoslavijo in Zakon o prisilni poravnavi izven konkurza iz leta 1929. Navedeni zakoni so natančno urejali uvedbo, postopek in zaključek stečaja ter pravice in obveznosti udeleženih subjektov. Stečajnemu dolžniku in upnikom so pravila v primeru doseženega soglasja dajala možnost sklenitve (prisilne) poravnave. Stečajni postopek je bil za dolžnika zelo rigorozen in je mnogokrat pomenil tudi odvzem častnih in državniških pravic ter uvedbo kazenskega pregona, zato so se mu dolžniki izogibali. Stečajni oziroma insolventni postopki v obdobju od 1868 do druge svetovne vojne so v osnovi bili zelo podobni postopkom po sedaj veljavnem zakonu ter so vsebovali večino sedaj poznanih pravnih institutov.

Title:BANKRUPTCY IN SLOVENIA FROM YEAR 1868 UP TO THE SECOND WORLD WAR
Abstract:Bankruptcy is a general enforcement procedure of the debtor's assets for the purpose of repayment of its creditors. The beginning of bankruptcy legislation dates back to the Roman era. The first modern bankruptcy laws were passed during the industrial revolution. The period from 1868 until the Second World War the Slovenian insolvency and bankruptcy procedures were governed by Austrian »Die Konkursordnung« or Bankruptcy order from 1868, Bankruptcy law for the Kingdom of Yugoslavia and the Law on compulsory settlement outside bankruptcy from 1929. Those laws governed the initiation of bankruptcy, bankruptcy proceedings, the conclusion of bankruptcy process and the rights and obligations of the participating entities. Debtor and creditors had legal option for concluding (compulsory) settlement. For the debtor bankruptcy proceedings were very rigorous and often entail deprivation of honor and citizenship rights, involving criminal prosecution, so the debtors would rather avoid initiation of bankruptcy. Bankruptcy or insolvency proceedings in the period between 1868 and Second World War are basically very similar to proceedings under the current law and had most of the currently known legal institutions.
