Title:HIPOTEKA IN LOČITVENA PRAVICA V STEČAJNEM POSTOPKU

Abstract:Hipoteka in ločitvena pravica v stečajnem postopku. Namen diplomskega dela je predstaviti uveljavljanje ter varstvo ločitvene pravice v stečajnem postopku in predstavitev problemov, s katerimi se soočajo upravitelji v postopkih insolventnosti. Prikazala bom stvarnopravne podlage za nastanek ločitvene pravice, s poudarkom na njenem uveljavljanju in varstvu v stečajnem postopku, kjer se bom kritično opredelila do veljavne zakonodaje in uveljavljene sodne prakse. Podlage za nastanek ločitvene pravice v stečajnem postopku so vse vrste zastavne pravice, zemljiški dolg, ki je bil sicer odpravljen, vendar je še vedno aktualen, pravica fiduciarja na podlagi prenosa v zavarovanje ter pravica fiduciarja pri odstopu terjatve v zavarovanje. Sodna praska je na tem področju enotna in za pridobitev ločitvene pravice v stečajnem postopku velja numerus clausus. Na primerih bom predstavila morebitne razloge za odstop od vzpostavljene sodne prakse. Predstavila bom postopek prijave terjatve od izdelave vloge upnika (ni vejic) do končnega seznama preizkušenih terjatev. Podrobneje bom prikazala vsebino prijave terjatve in ločitvene pravice ter probleme iz prakse. Načeloma velja pravilo, da morajo upniki svoje terjatve in ločitvene pravice v stečajnem postopku prijaviti. V nasprotnem primeru terjatve in ločitvene pravice prenehajo. Izjema je določena v 298.a členu ZFPPIPP, kjer se za prijavljene štejejo tiste terjatve in ločitvene pravice, ki so vpisane v zemljiški knjigi pri nepremičnini v lasti stečajnega dolžnika. Te terjatve in ločitvene pravice mora upravitelj v osnovni seznam vključiti sam. 298.a člen ZFPPIPP bom podrobneje predstavila in se do njega kritično opredelila. Posebej bom predstavila možnosti upravitelja za izpodbijanje prijavljene ločitvene pravice upnika in upnikove možnosti za njeno varstvo. Na koncu bom kratko predstavila poplačilo upnikov iz premoženja pridobljena s prodajo stvari v lasti stečajnega dolžnika, na katerih imajo upniki ločitveno pravico.

Title:MORTGAGE AND SEPARATE SETTLEMENT IN BANKRUPCY PROCEEDING
Abstract:Mortgage and right to separate settlement in bankruptcy proceedings. The aim of the thesis is to introduce enforcement and protection of rights to separate settlement in bankruptcy proceedings and presentation of the difficulties faced by liquidators in insolvency proceedings. Firstly, I will present the substantive legal basis for the formation of rights to separate settlement with an emphasis on its enforcement in bankruptcy protection where I will comment on the current legislation and the established judicial practice. The basis for the formation of preferential rights in bankruptcy proceedings are all types of liens, lend debt which has already been resolved, but is still up to date, the right of a trustee on the basis of the insurance transfer and the right to a trustee for the resignation of receivables as collateral. In this area judicial practice is uniform and numerus clausus is applied in order to obtain rights to separate settlement in bankruptcy proceedings. Several possible reasons for withdrawal from the established judicial practice will be presented in some cases. Further I will also present the claims reporting procedures starting with the preparation of the creditors’ application to the final list of basic receivable audit procedures. I will also present the contents of claims reporting procedures, rights to separate settlement and practical problems in detail. In principle, the rule is that creditors are obliged to report their claims and rights to separate settlement in bankruptcy proceedings. Otherwise claims and rights to separate settlement shall cease. An exception is stated in Article 298.a of ZFPPIPP where claims and rights to separate settlement, which are registered in the Land Register on the property owned by the bankruptcy debtor, are considered as reported. The liquidator is obliged to enlist these claims and rights to separate settlement in the list of basic receivables. Article 298.a of ZFPPIPP will be critically evaluated and presented in detail. I will specifically present the liquidators’ possibilities to avoid the creditors’ reported rights to separate settlement and the creditors’ possibilities for its protection. Finally, I will briefly present the payment of creditors with the assets gained from the sale of items belonging to the bankruptcy debtor, that are subjects of creditors’ rights to separate settlement.
