Title:ETIKA KAZNOVANJA IN RESOCIALIZACIJA ZAPORNIKA

Abstract:V magistrskem delu sem na podlagi literature raziskal filozofsko in zakonsko podlago prestajanja kazni zapora, delovanje zaporov, disciplino in nasilje v zaporih ter resocializacijsko funkcijo zaporov, vključno s pomočjo, ki jo je zapornik deležen s strani družbe po odpustu iz zapora. Predstavil sem poglede na delovanje zapora več filozofov in raziskovalcev drugih strok ter jih kritično ovrednotil. Podal sem svoja stališča o optimalnem delovanju zapora kot inštitucije. Pri svojem raziskovalnem delu sem uporabil induktivno in deduktivno sklepanje ter filozofsko intuicijo. Ugotovil sem, da obstajajo različne kaznovalne teorije, ki jih lahko v grobem delimo na retributivne in utilitaristične. Trdim, da je treba pri urejanju zakonodaje, povezane s kaznijo zapora, in njenem izvrševanju integrirati tiste teze enih in drugih, ki pozitivno vplivajo na sam namen kazni zapora, ki je večplasten, saj vključuje tako osamitev prestopnika kot njegovo prevzgojo, reintegracijo v družbo po prestani kazni, a hkrati tudi povračilo in zastraševanje glede na specifične in generalne prevencije. Na osnovi literature sem ugotovil, da je možno v slovenskih zaporih uvesti nove ukrepe za izboljšanje resocializacije zapornikov in njihovo reintegracijo v družbo po prestani kazni, predvsem je treba dosledno upoštevati zakonska določila.

Title:THE ETHICS OF PUNISHMENT AND THE RESOCIALISATION OF PRISONERS
Abstract:My master's thesis is aimed at researching the philosophical and legal basis of serving a prison sentence, the operation of prisons, discipline and violence in prisons as well as the resocialization process of prisons, including the help provided to prisoners by the society after being released from prison. As a matter of fact my master’s thesis comprises the views of several philosophers and researchers from other fields of work and I evaluated them critically. Moreover, I expressed my point of view about the optimum operation of prisons as institutions. Inductive and deductive inferences as well as the philosophical intuition were used when researching. I came to the conclusion that there are different punishment theories being roughly divided into retributive and utilitarian. I claim that when regulating and enforcing the legislation regarding the prison sentence all those theses should be integrated which have the positive influence on the purpose of prison sentence which is multilayer. However, it includes not only the offenders’ isolation but also their re-education, reintegration into society after being in prison, as well as the retribution and intimidation regarding specific and general preventions. The theoretical framework guided me to determine that it is possible to introduce new measures for the improvement of prisoners’ resocialization in Slovenian prisons and their reintegration into society after being released from prison, however, in compliance with legal provisions.
