Abstract:Diplomsko delo primerja dva učbenika rimskega prava, Justinijanove in Gajeve Institucije. Bizantinski cesar Justinijan je v luči zakonodajnega projekta in prenove pravnega študija izdal sodobni pravni učbenik za začetnike, ki je hkrati služil tudi kot priročnik za praktike. Institucije, ki so v bistvu zbir različnih besedil, sta pod vodstvom Tribonijana po večini zbrala in uredila profesorja prava, Teofil in Dorotej. Pri tem sta izbirala med besedili klasičnih pravnih učbenikov, gradivi klasičnih pravnikov in cesarskih konstitucij, Tribonijanovi pa naj bi bili predvsem deli besedila, v katerih je govor o spremembah, ki jih je uvedel Justinijan in v katerih cesar govori v lastnem imenu. Komisija se je pri pripravi učbenika najbolj oprla na slabe štiri stoletja starejše Gajeve Institucije. Za lažje razumevanje pomembnosti in obširnosti Institucij diplomsko delo najprej predstavi temeljne značilnosti in okoliščine v katerih sta deli nastali. V nadaljevanju diplomsko delo primerja besedilo in pri tem sledi zgradbi Institucij, ki so razdeljene na štiri knjige in v katerih so obdelana tri pravna področja, osebe(personae), stvari (res) in tožbe (actiones). Prvi knjigi Institucij sta, z izjemo uvodnih pojasnil, namenjeni osebnemu pravu, očetovski oblasti, zakonski zvezi in varuštvu. Drugi in tretji knjigi obravnavata premoženjsko pravo, v katero so uvrščeni načini pridobitve lastnine, oporočno in intestatno dedovanje ter obligacije. Četrta knjiga je v Gajevih Insitucijah v celoti namenjena procesnemu pravu, medtem, ko je v Justinijanovih Institucijah ta tema obdelana na kratko, zato pa vsebuje nekatere deliktne obveznosti. S primerjavo besedila je mogoče povzeti, da je komisija za pripravo Justinijanovih Institucij predvsem izpuščala nekatere pravne institute, ki so bili že zastareli, ob tem pa kljub vsemu ohranjala tudi historični prikaz in kontinuiteto v razvoju prava, ki ga je običajno sklenila z utemeljevanjem potrebe po novi ureditvi.

Title:GAIUS INSTITUTES AS A SOURCE OF JUSTINIAN'S INSTITUTES
Abstract:The thesis compares two textbooks of Roman law, The Institutes of Justinian and The Institutes of Gaius. In the light of legislative reform and reform of legal education, Byzantine emperor Justinian published a contemporary textbook for new students, which was at the same time a guide for practitioners. Institutes which are essentially a compilation of various texts, mostly compiled and edited by two professors of law, Theophilus and Dorotheus, under the supervision of Tribonian. Theophilus and Dorotheus chose texts from classical legal textbooks, materials of classical jurists and the imperial Constitutions, Tribonian part in the Institutes is expected to be particularly texts of the changes introduced by Justinian and texts where the emperor speaks in his own name. In the preparation of the Justinian’s textbook, Tribonian law commission mostly relied on the almost four centuries older Institutes of Gaius. For better understanding of the importance and scope of both Institutes, thesis firstly presents the basic characteristics and circumstances in which they were created. The following study compares the text of Institutes and follows their structure, which is divided into four books, and treated in the three areas of law, persons (personae), things (res) and actions (actiones). The first books of both Institutes are, with the exception of the introductory, intended to personal law, paternal authority, marriage and gardians. The second and third books deal with property laws, which include ways of acquiring property, testamentary and intestate inheritance and obligations. The fourth book is in Institutes of Gaius entirely dedicated to procedural law, while in Justinian's Institutes this topic is treated in a nutshell, therefore, contains some delict obligations. By comparing the texts of both Institutes can be summarized that the commission for the preparation of Institutes of Justinian mainly omitted certain legal institutions that were already obsolete, nevertheless preserving the historical representation and continuity of the development of the law, which is usually concluded by justifying the need for the new law.
