Title:KONFLIKT MED ZNAMKAMA TER VPRAŠANJE PREDNOSTI PREJ REGISTRIRANE ZNAMKE

Abstract:Znamka je ena izmed pravic industrijske lastnine, ki imetniku nudi izključno in absolutno pravico do varstva znaka, katerega se registrira kot znamka. Pravno varstvo znamke zagotavlja imetniku uresničevanje njenih osnovnih funkcij: na trgu razlikuje in individualizira blago in storitve, zagotavlja izvor blaga in storitev, ter s tem garantira njegovo pričakovano kakovost ter ga reklamira. Diplomsko delo na kratko povzema specifike posameznih vrst znamk in postopke registracije, saj je od njih odvisno če in kdaj bo znamki zagotovljeno varstvo. Trenutek prijave je odločilen za presojanje po načelu prednosti. Relativni razlogi za zavrnitev znamke preprečujejo možnost nastanka konfliktov med dvema enakima ali podobnima znakoma, ki označujeta enako ali podobno blago. V primeru registracije dveh enakih ali podobnih znamk pa prihaja do konfliktov, ki se razrešujejo po sodni poti na podlagi načela prednosti, in katerih rešitve diplomsko delo analizira. Kako se bo v sporu odločilo je odvisno od izključne pravice, njenih omejitev in trenutka nastanka le-te. Diplomsko delo povzame glavne značilnosti konflikta ter analizira prednost prej registrirane znamke v sodni praksi slovenskih sodišč, praksi sodišč drugih držav članic s podobno ureditvijo in Sodišča EU. Spremembe določb sekundarnih aktov EU s področja približevanja in harmonizacije prava znamk se bodo odražale tudi v konfliktu med dvema znamkama. Konflikti med dvema nacionalnima znamkama bodo z novimi postopkovnimi pravili pred vsemi nacionalnimi sodišči ali pa novimi upravnimi uradi medsebojno usklajeno urejeni, z večjim poudarkom na načelu prednosti imetnika prejšnje znamke. S sprejetjem novih določb Direktive 2015/2436 se ureditev nacionalnih znamk približuje ureditvi blagovnih znamk EU, s čimer bosta obe vrsti znamk v konfliktu enakopravnejši, čeprav se bo konflikt vedno urejal po nacionalnem pravu.

Title:CONFLICT BETWEEN TRADEMARKS AND QUESTION OF PRIORITY OF EARLIER TRADEMARK
Abstract:Trademark, as a type of industrial property right, gives its proprietor exclusive and absolute set of protection rights based on the registered mark. Trademark law provides legal measures for the trademark proprietor to ensure its primary functions: it distinguishes and individualizes goods and services from others, it guarantees the origin of goods and services to consumer as well as advertising them. The thesis shortly summarizes specific trades of different types of trademarks and registration procedures that are the basis for determining whether a trademark is entitled to legal protection. The point in time of application or registration is crucial in applying the principle of priority. Relative grounds for refusal of trademark prevent subsequent conflicting rights between two similar or identical signs, registered as trademarks that mark similar or identical goods or services. When the case of two similar or identical trademarks arises, the conflict between two rights is resolved by legal measures, based on the priority principle. Those solutions will be presented in this thesis. Outcome of before mentioned conflict is determined by exclusive right, its limitations and the moment of formation. The thesis presents main characteristics of existing conflict and jurisprudence in cases before Slovenian courts, courts of other member states and European Court of Justice as well. Changes, brought on by reformed secondary legislature of EU trademark law, will undoubtedly reflect in conflicts between two trademarks and their resolutions. Conflicts, arisen between two national trademarks, are going to be more coordinated due to new procedural regulations or new administrative authority, with greater emphasis on priority principle of earlier trademark. New provisions of Directive 2015/2436 are converging national trademarks closer to European trademark, so that when the conflict between them occurs, they are going to be based on more equal grounds.
