Title:POMEN PREIZKUSNE DOBE V POSTOPKU OSEBNEGA STEČAJA

Abstract:V slovensko zakonodajo je bil postopek osebnega stečaja uveden, glede na ureditve ostalih držav, pozno, in sicer šele v novejši potrošniški družbi. Od implementacije v zakonodajo leta 2008 je prišlo na področju osebnih stečajev do kar nekaj sprememb. Najpomembnejša je leta 2014 sprejeta novela Zakona o finančnem poslovanju, postopkih zaradi insolventnosti in prisilnem prenehanju ZFPPIPP-F, ko se je ukinil pogoj plačila predujma za stroške stečajnega postopka. Po sprejetju ukinitve plačila predujma kot pogoja za začetek stečajnega postopka je število osebnih stečajev neverjetno narastlo. V poplavi stečajev se je pojavila pomanjkljivost v ureditvi samega postopka osebnega stečaja. Pomanjkljivost se kaže tekom preizkusne dobe, natančneje v obdobju, ko bi moral stečajni dolžnik spremeniti svoje potrošniške navade, ki so ga vodile v insolventnost, saj mu zakon tekom preizkusnega obdobja ne določa posebnih aktivnosti v zvezi s svetovanjem in izobraževanjem, ki bi ga v prihodnje morda odvrnile od slabih potrošniških odločitev. Naloga stečajnega upravitelja je, da pazi na formalnosti pri izvajanju stečajnega postopka, ne določa pa aktivnosti v smislu preventive. V diplomskem delu je predstavljen postopek odpusta obveznosti in ureditve preizkusne dobe v slovenskem, nemškem in hrvaškem pravnem redu.

Title:THE SIGNIFICANCE OF A PROBATIONARY PERIOD IN A PERSONAL BANKRUPCY PROCEDURE
Abstract:The introduction of the personal bankruptcy procedure into the Slovenian legislation in the recent consumer society came in comparison to other state’s regulations relatively late. From the implementation into the legislation in 2008 there were many changes in the personal bankruptcy field. The most important is the Amendment of Financial Operations, Insolvency proceedings and Compulsory Dissolution Act (ZFPPIPP-F) from 2014, when the advance payment for the bankruptcy procedure cost was abolished. When the advance payment as the condition for starting a bankruptcy procedure was abolished, the number of personal bankruptcies drastically increased. Among the many bankruptcies there were deficiencies in the procedural arrangement of the personal bankruptcy. The deficiency is most evident during the probationary period, especially when the debtor should change his consumption habits, which led him to insolvency, since the law does not specify any specific activities nor provides any advising or education services in the probationary period, which would discourage the debtor from bad consumer decisions in the future. The liquidator’s task is to conform to the formalities in the performance of the bankruptcy procedure, while there are no activities in the sense of prevention. The diploma paper represents the discharge of liabilities and the regulation of the probationary period in the Slovenian, German and Croatian legal order.
