Abstract:	Diplomsko delo obravnava tematiko prenosa pooblastila iz detektivske pogodbe. Obravnavana tematika je predvsem pomembna zaradi vprašanja ali detektiv lahko veljavno prenese pooblastilo, ter v nadaljevanju ali so dokazi, ki jih v nadaljevanju pridobi detektivov substitut veljavni. V prvem delu naloge je na kratko opredeljen pojem detektivske dejavnosti, v nadaljevanju pa detektivovo delovno področje in oblike dela detektivov. Opredelitev temelji na Zakonu o detektivski dejavnosti. Nadalje je predstavljen pojem pooblastila na splošno, ki izhaja iz Obligacijskega zakonika. Nato pa je prestavljen pojem mandatne pogodbe, in sicer so povzeti bistveni elementi, ki se navezujejo na detektivsko pogodbo. V drugem delu naloge je opredeljeno razmerje, ki nastane na podlagi prenosa naročila, in sicer je poudarek obravnave na tem, katere subjekte štejemo za detektivovega substituta oziroma kateri so tisti subjekti za katere lahko štejemo, da kljub temu, da so oni opravili določeno nalogo, štejemo da je detektiv kot nosilec podjetja opravil delo osebno. Obravnavani sta dve zadevi iz judikature Višjega delovnega in socialnega sodišča, saj detektivi najpogosteje delujejo ravno na področju delovnopravnih zadev.

Title:	TRANSFER OF AUTHORISATION WITHIN THE DETECTIVE CONTRACT
Abstract:	This thesis treats the subject of detectives’ authorization transfer established within the detectives’ contract. The subject is important due to the question whether the detective can legally transfer his authorization and moreover is the evidence collected by his substitute valid. The first part of the thesis defines the detectives’ activities and is followed by the description of detectives’ work field and the types of detectives’ work. Definitions are based on Detective Activities Act. Following, the definition of authorization is presented; based on Code of Obligations. At the end of the first part the presentation of the contract of mandate can be found, involving the basic elements that are conected with the detectives' contract. The second part of the thesis deals with the relationship which originates within the transfer of detectives’ authorization. The emphasis is given to the question which subjects can be called detectives’ substitute or respectively which are those subjects whose work can be considered the work of the detective himself. Two judicatures of the Higher Labour and Social Court are treated, as detectives mostly work in the field of legal issues concerning employment.
