Title:Actio libera in causa : primerjalni vidik

Abstract:Actio libera in causa je kazenskopravni institut, ki ureja situacije, ko je bil storilec v trenutku izvršitve dejanja v stanju neprištevnosti, v katerega se je spravil sam z uporabo alkohola, drog, drugih psihoaktivnih snovi ali kako drugače. Z institutom je omogočeno presojanje o storilčevi krivdi v času njegove prištevnosti, čeprav je kaznivo dejanje izvedel, ko je bil neprišteven. V diplomskem delu smo prikazali analizo pravne narave in kriminalitetno-politične utemeljenosti instituta v slovenskem kazenskem pravu. Podali smo zgodovinski pregled nastanka in razvoja instituta v slovenski pravni ureditvi, spremembo instituta v novem Kazenskem zakoniku iz leta 2008 (KZ-1) v primerjavi s Kazenskim zakonikom iz leta 1994 (KZ) ter spremembe, ki jih je prinesla novela KZ-1B iz leta 2012. V nadaljevanju smo podrobno opisali dejanja, ki jih ima v mislih institut actio libera in causa. Glede teh dejanj razlikujemo med tremi možnostmi. Prva možnost je, da storilec oblikuje svoj naklep do dejanja še v normalnem duševnem stanju. Za drugo možnost je značilno, da pri storilcu ni naklepa za kaznivo dejanje v prištevnem stanju, vendar pozneje v stanju neprištevnosti izvrši določeno protipravno dejanje. Tretja možnost pa se nanaša na situacije kaznivih dejanj v javnem prometu, ko vozniki zaradi preutrujenosti in izčrpanosti zaspijo in povzročijo prometno nesrečo. Predstavili smo tudi analizo primerjalnopravne ureditve instituta v slovenski, hrvaški in makedonski pravni ureditvi, ki smo jih izbrali zaradi nekdaj skupnega Kazenskega zakonika SFRJ, kar ima za posledico, da so si ureditve še danes med seboj podobne. Na koncu smo obravnavali primere iz sodnih praks slovenskih in hrvaških sodišč, v katerih je prikazana uporaba instituta actio libera in causa.

Title:Actio libera in causa: a comparative view
Abstract:Actio libera in causa is a criminal law doctrine, which applies to situations, when the offender commits a criminal offence in a state of insanity, caused by himself as a result of the indulgence in alcohol, drugs, psychoactive substances or in any other way. The doctrine allows an assessment of the offender’s guilt in a state of sanity, althought the criminal offence has been performed in a state of insanity. The thesis demonstrates the analysis of the legal nature and criminal political merits of the doctrine in Slovenian criminal law. We have offered a historical overview and development of the doctrine in the Slovenian legal system, change of the doctrine with the new Penal Code of 2008 (Penal Code-1) compared with the Penal Code of 1994 (Penal Code) and the changes brought about by the amendment of the Penal Code 1B in 2012. Furthermore, we have explained in detail the offences that apply the actio libera in causa doctrine. Given the offences we distinguish between three possibilites. The first possibility is that the offender has already developed his intent for the criminal offence in a normal state of mind. In terms of the second case, the offender has no intent to commit the criminal offence in a state of sanity, however later he commits the unlawful action in a state of insanity. The third possibility reffers to the various situations of criminal actions in public transport, when vehicle operators fall asleep because of tiredness and exaustion, and this leads to them causing an accident. We have also presented an analysis of the comparative regulation of the doctrine in the Slovenian, Croatian and Macedonian legal system, which we have chosen because of the common Penal Code of the SFRY, resulting in the fact that the regulations have remained similar to this day. Finally, we have discussed some examples from the case law of Slovenian and Croatian courts, which illustrate the application of the doctrine of actio libera in causa.
