Title:NEDOLOČEN SPOL OTROKA - PRIKAZ NEMŠKE IN AVSTRALSKE PRAVNE UREDITVE

Abstract:V diplomski nalogi je obravnavana tematika nedoločenega spola otroka, ki je izziv spolni dihotomiji družbe, kjer priznavajo le moški in ženski spol. To, da družbe priznavajo le dva spola, ne pomeni, da druge oblike spola ne obstajajo, kar potrjujejo tudi biomedicinske raziskave. Že takoj ob rojstvu ali tudi pred, nas ljudje začnejo umeščati v sisteme, dodeljevati vloge ter pripisovati značilnosti glede na spol. V skladu z našim spolom nam potem izberejo tudi ime ter uskladijo njihov pristop ter obnašanje. V primeru, da se rodi interspolen otrok, je prisotna zmeda. Otroci in sprva predvsem starši se s tem stežka soočajo, saj svet o tem ni veliko poučen. Medicina to stanje dojema kot patologijo, kot motnjo v razvoju spola, zato zdravstveno osebje kolikor hitro je mogoče, potem poskuša ''normalizirati'' stanje posameznika, da se ohrani predpostavka o obstoju dveh spolov. Izziv spolni dihotomiji so tudi transseksualci, ki so prav tako zajeti v diplomski nalogi. Po mnenju strokovnjakov, gre v tem primeru za motnjo spolne identitete. Transseksualna oseba zavrača svoj biološki spol ter si želi, da bi bila nasprotnega spola. Tako interseksualci kot transseksualci so dokaz, da je spolni binarizem družbeni dogovor kulture, ki z neodobravanjem, usmerjanjem vsakršnih odstopanj ali kakšnim drugim načinom poskuša ohraniti spolno dihotomijo. Z zavedanjem in ozaveščanjem slednjega, so nekatere države postale bolj odprte ter že pravno priznavajo nedoločen spol otroka (Nemčija) oziroma oznako X (Avstralija), v kolikor se oseba identificira drugače kot s spolom, ki ji je bil pripisan ob rojstvu ali še kot dojenčku ali pa z družbenim spolom, ki ni ne moški ne ženska.

Title:UNSPECIFIED SEX OF THE CHILD - GERMAN AND AUSTRALIAN LEGAL SYSTEM
Abstract:This diploma thesis describes unspecified sex of the child, which is challenging gender dichotomy in societies that only recognize male and female gender. If society recognize only two genders, it does not mean that other variations of gender doesn't exist, which are also proving biomedical researches. Immediately after or even before birth of a child, people start to place us in systems, giving us roles, choosing our names, they also start to imply our characteristics and they align their approach and behaviour to us, everything on the grounds of our sex. In case, an intersex child is born, confusion is present. Children and in the beginning especially parents have some difficulties to face the ''problem'', becuase world is not so much informed about those conditions. Medicine recognize those conditions as a pathology, as disorders of sex developments and because of that health care professionals try to fix those individuals as soon as possible, to keep the assumption of existence of two sexes alive. Gender dichotomy is also challenged by transsexual people, which are also included in this diploma thesis. According to experts the transsexualism is disorder of sexual identity. Transsexual person deny the sex (or gender) that he or she was assigned at birth and wants to be and function as a member of the opposite sex. Intersexual and also transsexual people proof, that the binary system of sex/gender is a society agreement of culture, which maintains itself with disapproval, leading of any kind of divergence from this agreement or any other ways, just to keep gender dichotomy alive. With raising awareness of these conditions, some countries already become more open for it and they are already legally recognizing unspecified sex of a child (Germany) or the option X (Australia), in case that individuals identify as a gender other than the sex they were assigned at birth or during infancy, or they identify themselves as a gender which is not exclusively male or female.
