Title:Značilnosti spletnega trgovanja s poudarkom na pravnem vidiku

Abstract:Spletna trgovina je v sodobnem gospodarstvu vse bolj razširjena oblika poslovanja in boj spletnih trgovcev za prevlado na spletu postaja vse ostrejši. Glede na hitro rast spletnega trgovanja v Evropi in tudi v Sloveniji, je nujno, da pravo regulira tudi to dejavnost. Velja namreč, da tam, kjer so ljudje, tam je pravo. Prav zaradi tega v zadnjih letih opažamo vse večjo regulacijo spletnih trgovin in njihovega delovanja. Največ pravnih pravil obravnava zaščita potrošnikov. Tukaj se največ sprememb dogaja tako v slovenski zakonodaji kot tudi v evropski. Spletni trgovec mora upoštevati tudi pravila Zakona o elektronskem poslovanju na trgu. Če na spletnem mestu zbira osebne podatke kupcev in obiskovalcev, mora imeti sistem, ki ustreza Zakonu o varstvu osebnih podatkov. Uporaba grafičnih elementov in fotografij na spletnem mestu poleg tega zahteva še ustrezno pogodbo po avtorskem pravu. Splošni pogoji in pogodbe, ki jih sklepa s kupci dobavitelji itd. so podvržene določbam Obligacijskega zakonika. Namen magistrskega dela je opredeliti vse pravne podlage, ki jih moramo ob delovanju spletne trgovine upoštevati. Magistrska naloga je lahko v pomoč vsem, ki bi se radi lotili spletnega trgovanja in se v obilici zakonadaje ne znajdejo. Ta magistrska naloga jim ponuja združeno vso zakonodajo na enem mestu.

Title:Online shops with empasis on legal aspects
Abstract:Online shop in in the modern economy increasingly widespread form of business and the online retailers' fight for supremacy on the Internet is becoming fiercer. Given the rapid growth of online trading in Europe and also in Slovenia it is necessary that the law regulates also this activity. There is a saying that where there are people, there is law. That is why we have been seeing an increasing regulation of online stores and their operations in the recent years. Consumer protection deals with most of these rules. Here the majority of changes are applied, both in the Slovenian as well as European legislation. Online retailers must comply also with the rules of the Law of Electronic Commerce. Should their site collect personal date of customers and visitors, they must have a system that meets The Law on Personal Data Protection Act. Any use of graphic elements and photography on their site, however, requires a corresponding contract under copyright act. General conditions and contracts which they conclude with customers, suppliers, etc. are being subject to the provisions of the Obligations Code. The purpose of this Master's Thesis is to identify all legal basis that should be considered when running an online store. The thesis can be useful for anyone who would like to start his or her own business in online trading yet are unfamiliar with the abundance of legislation. Therefore this thesis provides them with all the legislation in one place.
