Title:Zaznamba vrstnega reda s pregledom sodne prakse

Abstract:Zemljiškoknjižno pravo in pravni institut zemljiške knjige predstavljata na področju nepremičninskega pravnega prometa ključen dejavnik. Zemljiška knjiga s svojimi načeli, predvsem z načelom javnosti, vsakomur omogoča vpogled in pridobitev zemljiškoknjižnih podatkov o določeni nepremičnini. V povezavi z načelom javnosti, zemljiška knjiga izključuje, da bi se stranke lahko sklicevale na nepoznavanje dejanskih pravnih dejstev in pravic, ki se vpisujejo v zemljiško knjigo. Tako lahko kupec pred nakupom nepremičnine v zemljiški knjigi preveri, če je ta obremenjena s kakšno pravico, ki bi po nakupu bremenila njega (npr. hipoteka). Na prvi pogled pravni institut zemljiške knjige daje vtis, da se z vpisom in pridobitvijo določene knjižne pravice zagotovi popolno varstvo strank v zvezi s posli z nepremičninami. Poudariti moramo, da čeprav velikokrat vknjižbo v prvi vrsti pogovorno označujemo kot najpomembnejšo in morda celo kot edino vrsto vpisa, še zdaleč ni tako. Zakon o zemljiški knjigi (ZZK-1) zraven vknjižbe, kot vrste glavnega vpisa, pozna tudi predznambo, zaznambo, ter dva pomožna vpisa, plombo in poočitev. V središče svoje diplomske naloge sem postavila zaznambo vrstnega reda, saj je ta izrednega pomena v pravnem prometu z nepremičninami. Je eden izmed glavnih vpisov v zemljiško knjigo, pri katerem je najpomembnejša objava in vpis določenih pravno pomembnih dejstev ali osebnih lastnosti imetnika. S tem z zaznambo vrstnega reda dosežemo varovanje vrstnega reda pridobitve pravice, katere vpis bo predlagan pozneje, to je s trenutkom, od katerega zaznamba učinkuje. Poenostavljeno lahko povemo, da kdorkoli, ki pridobi kakršnokoli knjižno pravico za tem, ko je zaznamba že pridobila učinke, se na nepoznavanje pravnega dejstva v zvezi z nepremičnino ne more sklicevati.

Title:NOTE OF ORDER WITH CASE LAW REVIEW
Abstract:Land register law and the legal institute of land register represent a key factor in the legal field of property transactions. With is principles, most notably with the principle of being public, the land register allows anyone to access and acquire land registry information about a certain property. In relation to the principle of being public, the land register excludes clients from pleading ignorance of legal facts and rights that are entered into the land register. This allows the buyer to look and see if the property itself is encumbered by some others legal rights that could burden him after the purchase (e.g. mortgage). At first glance the institute of land register gives the impression that with entry and acquisition of a certain land right in relation to property transaction complete protection for the party is ensured. We have to emphasize that, although the register entry is first and foremost commonly referred to as the most important or even as the only entry, it is not so. Besides the book entry, the Land Register Act (ZZK-1) classifies entries into notes and preliminary notes as principal entries, and seal and rectification as subsidiary entries. The focus of my diploma thesis is the note of order due to its tremendous importance in legal property transactions. It is one of the main entries in the Land Register and the most important components of it are publication and entry of certain legally relevant facts or personal qualities of the holder. In doing so, the note of order ensures protection of the order of gaining rights, the entry of which will be proposed at a later date, i.e. at the moment when the note comes into effect. Simply put, anyone who gains any land right after the note already came into effect cannot plead ignorance of legal facts related to property.
