Title:Načrtovanje nabave v okviru javnih naročil v podjetju dem d.o.o.

Abstract:Zaradi evropskih direktiv in zakonskih zahtev Zakona o javnem naročanju ZJN-3 bo teženj po celovitem obvladovanju nabav, vključno z načrtovanjem le-teh, pri javnih naročnikih na splošnem in prav tako infrastrukturnem področju v prihodnosti vse več. Da celotni sistem javnega naročanja deluje in sledi ciljem javnega naročanja, morajo naročniki pri izvajanju postopkov javnih naročil spoštovati temeljna načela javnega naročanja. Zmotno je prepričanje naročnikov, da temeljna načela veljajo samo za javna naročila nad mejnimi vrednostmi ZJN-3. Z novim Zakonom ZJN-3 je še bolj poudarjeno temeljno pravilo, da naročnik ne sme razdeliti javnega naročila oz. ga oblikovati v več javnih naročil, da bi se izognil uporabi zakona o javnem naročanju. Z načrtovanjem v okviru javnega naročanja se postavljajo cilji javnega naročanja in načini njihove uresničitve:  izbor najprimernejšega in pravilnega postopka javnega naročila,  učinkovito in racionalno gospodarjenje z razpoložljivimi sredstvi,  zagotoviti zakonit in pošten izbor ponudnika na trgu EU. Letni načrt nabav je torej osnovno izhodišče za preprečitev drobljenja naročil zaradi zahtev zakonodaje, prav tako pa je nujen s stališča ekonomičnosti izvedbe posameznih nabavnih postopkov, načrtovanja resursov itd. Priprava letnega načrta naročil v Sloveniji ni zakonska obveza naročnikov, zato ZJN-3 ne predpisuje postopkov priprave in izvedb načrtovanja naročil, prav tako ne definira njegovih vsebin in oblik. Kot tudi v ostalih členih ZJN-3 je zakonodaja glede drobljenja naročil in glede pravil istovrstnosti predmetov naročil nejasna, tako da si pač zakonodajo vsak naročnik tolmači po svoje. V analiziranem podjetju DEM naročil ne načrtujejo, zato obstaja tveganje izbora neustreznih postopkov in tveganje drobitve naročil, prav tako ni ekonomskih učinkov zaradi racionalnejših postopkov, poenotenih vrst blaga in storitev. Problemi izhajajo tudi iz neustreznega upravljanja nabave in (ne)sodelovanja ostalih strokovnih služb v ciklu nabave. Razlog je tudi v pomanjkljivem znanju s področja javno-naročniške zakonodaje, pomanjkanju izkušenj in nepoznavanju odločitev Državne revizijske komisije in Računskega sodišča. Upam, da bo vodstvo analiziranega podjetja prepoznalo aktivnosti in procese v pred razpisni fazi javnih naročil kot nujne in pomembne za celotno organizacijo, jim dalo ustrezno težo, zagotovilo ustrezne resurse v znanju in ljudeh ter zagotovilo in koordiniralo sodelovanje različnih služb na vseh nivojih upravljanja.

Title:Purchasing planning in public procurement process in dem d.o.o.
Abstract:Due to the European directives and legal requirements of the Public Procurement Act (ZJN-3), the tendency to master public procurement, including its planning, will increase in the future regarding the public contracting authorities in general and in the infrastructure sector. In order for the whole system of public procurement to function and follow the public procurement objectives, the contracting authorities have to comply with the fundamental principles of public procurement when implementing the procedures of public procurement. Among the contracting authorities there is a false belief that the fundamental principles apply only to public procurement above the threshold values of ZJN-3. The new ZJN-3 law emphasizes the fundamental principle stating that the contracting authority must not subdivide a public procurement or form it into several public procurements in order to avoid the Public Procurement Act regulations. By planning within the frameworks of public procurement, we set objectives of public procurement and methods of their implementation:  Selecting the most suitable and correct public procurement procedure;  Effective and rational management of available funds;  Ensuring legal and fair selection of tenderer/provider within the EU market. The annual procurement planning is therefore a basic platform to prevent subdividing procurements due to legislation requirements, and is also essential from the economic perspective of implementing individual procurement procedures, resource planning, etc. Preparation of annual procurement plan is not a legal obligation of contracting authorities in Slovenia, and therefore ZJN-3 does not prescribe procedures of preparing and enforcing procurement planning, nor does it define its content and form. The legislation of ZJN-3 is also unclear in other articles regarding the subdividing of procurements and regulations of equivalent subjects of contracts, thus allowing each contracting authority to interpret it as they please. In the analysed company of DEM, the procurements are not planned, and therefore there is a risk of selecting unsuitable procedures and subdividing procurements, as well as not having economic effects of more rational procedures, unified varieties of goods and services. The problems derive from unsuitable management of procurement and (non-) cooperation with other professional departments within the procurement cycle. Other reasons lie in the insufficient knowledge in the field of public procurement legislation, lack of experience and not being informed of the decisions made by the National Review Commission and the Court of Auditors. I hope that the management of the analysed company will recognise the activities and procedures in the pre-tender phase of public procurement as urgent and important for the whole organisation, give them suitable importance, ensure adequate resources in knowledge and people, and ensure and coordinate cooperation of various departments on every level of management.
