Title:Varstvo imetnika lastninske pravice na nepremičnini v pričakovanju v razmerju do imetnika prisilne hipoteke

Abstract:Lastninska pravica se pridobi na podlagi pravnega posla, dedovanja, zakona ali odločbe državnega organa. Splošni pogoji za učinkovit prenos lastninske pravice s pravnim poslom so: obstoj veljavnega zavezovalnega pravnega posla, s katerim se imetnik pravice zaveže prenesti pravico na drug subjekt, odsvojitelj mora imeti sposobnost, da lahko veljavno in učinkovito razpolaga z lastninsko pravico, obstajati mora razpolagalni pravni posel in izpolnjeni morajo biti drugi pogoji, ki jih določa zakon (na nepremičninskem področju je to vpis v zemljiško knjigo). Ne glede na zakonsko dikcijo, ki ne dopušča dvoma o pogojih, ki morajo biti za pridobitev lastninske pravice izpolnjeni, je sodna praksa iznašla lastninsko pravico v pričakovanju. Gre za vmesno lastninsko stanje na nepremičnini, ko je pravnoposlovni pridobitelj lastninske pravice kljub odsotnosti vpisa v zemljiško knjigo, že deležen določenega lastninskega varstva. V magistrskem delu se ukvarjam z učinki lastninske pravice v pričakovanju v razmerju do prisilne hipoteke. Prisilna hipoteka lahko nastane v postopku izvršbe, v postopku zavarovanja ali na podlagi predhodne odredbe. Vse prisilne zastavne pravice nastanejo v posebni situaciji, ki se pomembno razlikuje od okoliščin, v katerih nastane pogodbena hipoteka. Kupec, ki pred začetkom stečajnega postopka odsvojitelja, razpolaga z notarsko overjeno zemljiškoknjižno listino, ima (lahko) izločitveno pravico oziroma neposredno vknjižbeno pravico. Če nepremičnina ne spada v stečajno maso in tako ne služi poplačilu upnikov v stečajnem postopku, je logično, da upnik tudi v izvršbi ne more poseči po tej nepremičnini, da bi dosegel poplačilo svoje terjatve. Imetniku lastninske pravice v pričakovanju je tako zagotovljeno varstvo v izločitveni pravdi. Imetnik lastninske pravice v pričakovanju pa izkazuje pravico, ki izvršbo preprečuje. Upravičen je torej tudi do ugovora tretjega. Prav tako ima pravni interes za uveljavljanje zahtevka za ugotovitev neobstoja ločitvene pravice in za vložitev izbrisne tožbe.

Title:Protection of anticipated ownership right in relation to a forced mortgage
Abstract:Right to property is obtained on the basis of a legal transaction, inheritance, law or on the basis of a decision of a national authority. The general conditions for an affective transfer of property with a legal transaction include: existence of a valid binding legal transaction, whereby the holder undertakes to transfer the property to another entity; the transferor must have the ability to dispose of the right to property in a valid and effective manner; there must be a legal transaction disposing of right to property, and other conditions defined by law also have to be met (in terms of real property, this refers to the entry in the land register). Irrespective of the legal formulation, which does not raise any doubts as to the conditions, which must be met for the acquisition of the right to property, the judicial practice has invented anticipated right to property. It is an interim ownership status of a property, when the acquirer of the right to property by way of legal transaction, despite no entry in the land register, is already entitled to specific property protection. My master’s thesis deals with the effects of anticipated right to property in relation to forced mortgage. Forced mortgage can result from enforcement proceedings, underwriting process or on the basis of preliminary injunction. All involuntary liens occur in special situations, which significantly differ from the circumstances, which give rise to contractual mortgage. The buyer, who disposes of a notarised land registry document before the start of bankruptcy proceedings of the transferor, (may) have the right to separate satisfaction or direct right to entry in the register. If real property does not fit under the bankruptcy estate and it does not serve for the repayment to the creditors in the bankruptcy proceedings, it seems logical that the creditor cannot make use of the property in question in the enforcement action in order to repay the claim. Therefore, the holder of the anticipated right to property is provided with protection in a separation lawsuit. However, the holder of the anticipated right demonstrates the right, which prevents enforcement action. Therefore, he is also entitled to the third-party proceedings. Likewise, he has a legal interest to enforce the claim to determine the non-existence of the right to separate satisfaction and to lodge cancellation lawsuit.
