Title:Uvedba teleskopske palice in tonfe v policijo - vpliv na število uporab palice kot prisilnega sredstva : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:V prvem delu diplomskega dela smo preučevali človekove pravice in temeljne svoboščine. Preučevali smo delovanje Varuha človekovih pravic, ki ima zelo pomembno vlogo pri varovanju človekovih pravic in temeljnih svoboščin v razmerju med posameznikom in državnimi organi. Preučili smo tudi temeljna načela za uporabo prisilnih sredstev. Kot so načela zakonitosti, sorazmernosti, nujnosti, strokovnosti in humanosti. Uporabili smo različne metode raziskovanja, kjer so ugotovili, da morajo policisti pri opravljanju nalog, strogo upoštevati našteta načela pri uporabi prisilnih sredstev. V drugem delu smo preučevali prisilna sredstva pri čemer smo se osredotočili na palico. Torej predstavili, primerjali in opisali smo gumijevko, palico z ročajem – tonfo in teleskopsko palico. Ugotovili smo, da so palice zelo učinkovite in vsestranske pri opravljanju nalog policista. Tonfa je narejena iz lesa ali iz drugih materialov, gumijevka je gumijasta palica, v tujini pa jo poznajo v daljši in trši obliki. Teleskopske palice pa so bile dokončno nabavljene za slovensko policijo v juniju leta 2008. Ugotovili smo, da se je uvedba tonfe pojavila pri nas v Sloveniji v letu 2003. V Ameriki pa se je tonfa (PR 24) uradno začela uporabljati že leta 1972. Zanimalo nas je, koliko krat je bila palica uporabljena kot prisilno sredstvo v slovenski policiji, v obdobju od leta 2010 do leta 2015. S pomočjo statističnih podatkov policije smo ugotovili, da se uporaba palice zmanjšuje. Raziskali smo tudi poškodbe pri uporabi palice. Kjer smo ugotovili, da se je število poškodb z uporabo palice zoper kršitelje zmanjšala. Zanimalo nas je katera izmed palic je najučinkovitejša za uporabo. Kjer smo primerjali gumijevko in tonfo, in ugotovili, da je gumijevka v primerjavi s tonfo, manj učinkovita pri izvajanju nalog policista. Z pomočjo statističnih podatkov policije, smo prišli do končnih podatkov, kjer smo ugotovili, da se je uporaba palice zmanjšala in s tem so se zmanjšale tudi storjene poškodbe s palico zoper kršitelje.

Abstract:In the first part of our thesis we presented the human rights and fundamental freedoms, which accompany us through all written theme of thesis. We presented the functioning of Ombudsman, which has a very important role in protecting human rights and fundamental freedoms in relation between individual and public authorities. We also presented the basic principles for using the coercive measures such as the principles of legality, proportionality, necessity, professionalism and humanity. We have used different research methods, where we found out when police officers are doing their tasks they have to strictly observe the principle of coercive means. In the second part we considered the coercive measures and focused on a rod. We present, compared and described a truncheon, a rod with a handle and telescopic rod. We have found out that the rods are very effective and versatile while the police officers are doing their tasks. A rod with a handle is made from wood or other materials, truncheon is made from rubber but in countries abroad is known in much longer and harder form. Telescopic rod were finally purchased for Slovenian police in June 2008. We find out that the introduction of rods with handle in Slovenia was in 2003. America has the same rod officially began to use in year 1972. We also wanted to know how many times was the rod used as a coercive measure in period from year 2010 till year 2015. With the help of statistics data from police, we have found that the usage of the rods are decreasing. We also researched the injuries by using the rod, where we found out that the number of injuries made with the rods are decreasing. We wanted to know which rod is the most effective to use, where we compered the truncheon and a rod with a handle and found out that truncheon compared to a rod with a handle is less effective. With the help of statistical data from police, we came to the final data, where we found that the use of rods have decreased and within that the committed injuries against violators decreased.
