Title:Slovenska policija in prisilno ustavljanje plovil : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:Obravnavan problem v diplomski nalogi je postopek prisilnega ustavljanja plovil na območju slovenskega teritorialnega morja s Policijo v vlogi pooblaščenega in izvršilnega organa. Raziskovanje obravnavanega problema je pomembno, ker je lega Slovenije z vidika pomorske države v središču trgovskih poti, v zadnjem času pa tudi morebitna točka vstopa za nezakonite migracije iz držav kriznih žarišč, kot so Sirija, Turčija, Somalija in druge. Slovensko teritorialno morje je na severu omejeno z italijansko obalo, na jugu z reko Dragonjo, skupaj pa meri nekaj več kot 300 km², kar predstavlja slovenskim policistom veliko področje, potrebno nenehnega nadzora in po potrebi izvajanja postopkov prisilne ustavitve plovil. Na območju notranjih morskih voda in teritorialnega morja Republike Slovenije veljajo pomorski predpisi, ki jih je vsak uporabnik morskega prostora dolžan poznati in upoštevati. Vsebina teh predpisov in njihovo dosledno upoštevanje sta gotovo ena izmed osnov za varno plovbo. V primeru kršenja predpisov, ki urejajo razmerja na morju, plovilih in v pristaniščih, je storilec kazensko in odškodninsko odgovoren. Zagotovljen je tudi nadzor nad izvajanjem predpisov, varnostjo plovbe, opravljanjem morskega prometa ter vzdrževanjem objektov za varnost plovbe in plovnih poti. V diplomski nalogi je poudarek na izvajanju postopka prisilne ustavitve plovil, ki ga pooblaščeno izvaja slovenska Policija, izpostavljene pa so tudi težave, ki pri tem nastajajo ter predlagane morebitne rešitve.

Title:Slovenian police and forcibly stopping vessel
Abstract:Slovenian Police and forcibly stopping vessel Addressing problem of the thesis is being compulsorily stopping vessels in the Slovenian territorial sea with the police as authorized and executive body. I decided to explore the problem because the position of Slovenia in terms of maritime countries is in the center of trade routes, and recently also the potential entry point for illegal migration from areas of war such as Siria, Turkey, Somalia and others. Slovenian territorial waters bounded on the north by the Italian coast, in the south of the river Dragonja, which together measure more than 300 square kilometers, representing Slovenian police officers lot area required constant supervision and, if necessary, the implementation procedures of forced detention of the vessel. In the area of internal waters and territorial sea of the Republic of Slovenia subject to the maritime regulations by any user of the marine space required to know and observe. The content of these regulations and their strict observance are certainly one of the bases for safe navigation. In case of violation of the rules governing relations in the sea, boats and ports, the perpetrator of the criminal and tort liability. Guaranteed is the implementation of regulations, safety of navigation, the supply of maritime transport and maintenance facilities for the safety of navigation and waterways. In this thesis I dedicated the implementation of compulsory detention of the vessel, which is empowered to carry Slovenian Police, highlighted the difficulties that arise in this connection and search for potencial solutions.
