Title:Pravni vidiki geoblokiranja v Evropski uniji

Abstract:Evropska unija namenja velik del svojih sredstev vzpostavitvi enotnega trga, ki bi imela za posledico ekonomsko rast vseh držav članic. Del končnega cilja popolnega enotnega trga predstavlja enotni digitalni trg, ki pa si ga lahko zamislimo le ob visoki digitalni integraciji potrošnikov. Tema tega diplomskega dela je geoblokiranje, praksa trgovcev, ki potrošnike diskriminira na podlagi državljanstva ali prebivališča. Geoblokiranje predstavlja veliko oviro za vzpostavitev enotnega digitalnega trga in s tem tudi oviro za celoten enotni trg V prvem delu diplomskega dela predstavim enotni digitalni trg, njegove cilje in njihovo (ne)uspešnost. Nadalje predstavim različne oblike geoblokiranja (tiste, ki vsebujejo vprašanja avtorskega prava in druge oblike geoblokiranja) ter njihove pozitivne in negativne posledice. Sledita predstavitev in kritika pravne regulacije preprečevanja geoblokiranja v EU do sedaj (zlasti preko 20. člena Direktive o storitvah), nato pa predstavim predloge Uredb, ki naj bi geoblokiranju naredile konec. Za popolno odpravo geoblokiranja, bi bilo potrebno predloge Uredb nadgraditi tako da bi vprašanja avtorskega prava in druge oblike geoblokiranja urejali enotno. Vendar pa je ob tem potrebno poudariti, da bi odprava geoblokiranja poleg pozitivnih pridobitev (kot denimo nova delovna mesta, nižje cene, povečana prodaja itd.), prinesla tudi negativne posledice (kot denimo manjše gibanje prebivalcev, negativne posledice za okolje, socialna izolacija itd.).

Title:Legal aspects of geo-blocking in the European union
Abstract:The European Union devotes a great deal of its resources to the creation of a single market which will result in the economic growth of all Member States. Part of the goal of a complete single market is a single digital market which can only be imagined with high digital consumer integration. The theme of this thesis is geo-blocking, the practice of traders who discriminate against consumers on the grounds of citizenship or residence. Geo-blocking presents a major obstacle to the creation of a single digital market and hence presents a barrier to the whole single market In the first part of the diploma thesis I present a single digital market, its goals and its failures and achievements. Furthermore, I present various forms of geo-blocking (those that contain copyright issues and other forms of geo/blocking) and their positive and negative consequences. The following text is a presentation and a critique of the legal regulation of the prevention of geo-blocking in the EU to date (in particular through Article 20 of the Directive), and then I present the proposals of the Regulations, which are supposed to end the geo-blocking. In order to end geo-blocking, the Regulation proposals should be upgraded, so that they would uniquely regulate copyright issues and other forms of geo-blocking. However, it should be emphasized that the elimination of geo-blocking, in addition to positive acquisitions (such as new jobs, lower prices, increased sales, etc.) would also have negative consequences (such as decline population movements, negative consequences for the environment, social isolation, etc.).
